The detailed description of the subject of the contract is specified in Annex No. 2 to the Specification of Contract Terms. The subject of the contract is free from physical and legal defects, factory new, not previously used by third parties, in particular, it has not served as a used item for demonstration purposes and is of good quality. It has also not been previously refurbished. The medical devices offered, which are the subject of the contract, must meet the requirements specified in the Act of 7 April 2022 on medical devices (i.e. Journal of Laws of 2024, item 1620). The Contractor is obliged to submit an offer for the whole or the selected part(s) chosen by them, taking into account all the items of the given part. All the requirements specified in the contract documents constitute minimum requirements, and their fulfilment is obligatory. Failure to meet the above minimum requirements will result in the offer being rejected as not complying with the terms of the contract pursuant to Article 226(1)(5) of the Pzp Act. If the Ordering Party specifies trademarks, patents, or origin, sources, or a particular process that characterises the products or services supplied by a specific Contractor in the description of the subject of the contract, equivalent solutions to those described may be offered, provided that they maintain the same minimum technical, quality, and functional parameters. In the event that references to standards, technical assessments, technical specifications, and technical reference systems, as mentioned in Article 101(1)(2) and (3) of the Pzp Act, are included in the description of the subject of the contract, the Ordering Party allows equivalent solutions to those described. The Contractor who refers to equivalent solutions is obliged to prove that the solution offered by them meets the requirements specified by the Ordering Party. In such a case, the Contractor attaches to the offer a list of equivalent solutions along with its description or standards.
