Construction of the Westerplatte and 1939 War Museum – Branch of the Museum of the Second World War in Gdańsk – Scope 2. The subject of the contract includes the execution of construction works and the completion of the construction procedure, as mentioned in Section 5c of the Construction Law (i.e. Journal of Laws 2025 item 418 as amended) [hereinafter: Construction Law] for the investment task covering the implementation of Scope 2 of the investment named „Construction of the Westerplatte and 1939 War Museum – Branch of the Museum of the Second World War in Gdańsk – Scope 2”. 1.1. The subject matter of the contract includes all works, activities and tasks necessary for the implementation of the investment task, including the following elements: • Construction of a two-storey, underground Main Museum Building with a usable area of 7,051.54 m2, • Construction of a fire road with a manoeuvring area for a fire engine, • Restoration of historical communication routes, • Restoration of the historical gun emplacement, • Reconstruction of the Popielnik relic, • Conservation repair of objects: Monument to the Defenders of the Coast, Guardhouse No. 3, southern wing of New Barracks – permanent ruin, Monument of the 7 Torches, • Clarification of the outline of objects: Mikołajewo, NCO Villa, northern wing of New Barracks, Old Barracks, NCO Casino, Monument to the 10th Anniversary of Regaining Independence, • Conservation of the existing inscription „Never Again War”, • Execution of small architecture elements, • Demolition of objects: including reinforced concrete nests of the open-air exhibition, elements of the IS-2 tank, ahistorical communication routes, ahistorical ground steps, ahistorical buildings, reinforced concrete canopy and sales pavilion, southern parking, flagpoles, concrete information boards, steel stands, small architecture elements, • Tree felling and execution of replacement plantings, • Construction and reconstruction of external networks, • completion of the construction procedure, as mentioned in Section 5c of the Construction Law. 2. The subject of the contract is described in detail in Annex No. 1 to the Invitation to Tender „Description of the Subject of the Contract” (DSC) and in the technical design documentation (constituting Annexes 1 to 4 to the DSC), and the contract template constituting Annex No. 7 to the Invitation to Tender. 3. The Contractor will provide a minimum 60-month guarantee for the subject of the contract, from the date of signing the final acceptance protocol. In addition to the guarantee, the Contractor will be liable for a period of 5 (five) years for defects in the performance of the Works, which are the subject of the Contract, in accordance with the provisions of Article 638 of the Civil Code in connection with Article 656 of the Civil Code in connection with Articles 556-576 of the Civil Code. 4. The Contractor, whose offer is selected as the most advantageous, will be obliged to have: • current civil liability insurance for the activities carried out in connection with the subject of the contract in the amount of insurance not less than 50,000,000 PLN for the entire period of the contract (until the completion and acceptance of the works); • current insurance of all construction and assembly risks / CAR insurance, EAR insurance, the subject of which will be the contractual works, the value of which will be the value of the construction works carried out, not less than the net value of the offer, as well as all materials, construction equipment with the construction site, and any property located on the construction site and in its vicinity, with the insurance period starting from the date of handover of the construction site/land until the end of the contractual works, confirmed by the final acceptance. 5.
