Description

Subject of the contract: The subject of the contract concerns the execution of a so-called DBFM programme (“Design, Build, Finance & Maintain”). With the current contract, Ghent University (hereinafter UGent) wishes to appoint a contractor for the renovation or demolition and new construction of the student residence Vermeylen. To this end, the tendering procedure must lead to the conclusion of a DBFM agreement between the contracting authority and the chosen bidder (henceforth the contractor). Student residence Vermeylen currently has 465 student rooms (56 per floor and 17 on the ground floor) distributed over eight (9) storeys (eight (8) above ground and one (1) basement) and is equipped with, among other things, shared showers, toilets and kitchen(s) on each floor. https://www.ugent.be/student/nl/studentenleven/huisvesting/homes/homes-residenties/vermeylen.htm This contract is being tendered to bring the student residence into line with the most recent legislation and standards regarding student housing, the environment and energy. This project must contribute to UGent's mission to rent out high-quality and affordable student accommodation to students. The focus of UGent's housing policy is on target groups. UGent student rooms are rented out at prices below the market average, and students with low incomes are given priority. Within this contract, UGent wishes to realise a maximum number of basic rooms. A basic room is a room according to the standards of the Flemish Housing Code, where the bathroom and kitchen are provided collectively, and with a minimum net floor area of 12 m² (or 10 m² if it is a room in an apartment). This means that UGent is aiming for the realisation of 100% basic rooms within this project. This can only be deviated from if this is required by the environmental permit for the project by the permitting authority. This must be demonstrated to UGent by the contractor. If the permitting authority requires that comfort rooms and/or studios must be realised within the project, these must also comply with the standards of the Flemish Housing Code and the aforementioned programme of requirements. Any such mandatory adjustments to the contractor's design must already be included in the price and cannot be a reason for adjusting the offered prices. An essential part of the contract also concerns the maintenance of the building (maintain). UGent understands this to mean that the contractor will carry out all activities aimed at keeping the building and the installations present in good condition (tenant and landlord/owner maintenance incl. compliance). The following activities are not included and will therefore be organised by UGent itself (non-exhaustive list): - The cleaning of the building; - Window cleaning (inside and outside); - Green maintenance; - Waste management; - The consumption of utilities incl. telephony and data. The execution of the contract, more specifically the design (Design) and the construction (Build), will be paid for by the contracting authority on a deferred basis (Finance), more specifically from the provisional completion of the construction works and this monthly per room for a period of 30 years. The price that the contracting authority pays for this to the contractor is the monthly price per basic room as stated in the tender on the basis of which the contract was awarded to the contractor. If, due to requirements of the permitting authority, comfort rooms and/or studios have to be realised, the following prices will apply: 1) comfort rooms type 1 (with own toilet and bathroom and kitchenette): maximum 40% above the specified monthly price per basic room; 2) comfort rooms type 2 (with own bathroom and toilet) and comfort rooms type 3 (with own kitchenette): maximum 25% above the specified monthly price per basic room 3) comfort rooms type 4 (with own toilet and kitchenette) and comfort rooms type 5 (with own bathroom and kitchenette): maximum 30% above the specified monthly price per basic room; 4) comfort rooms type 6 (with own bathroom) and comfort rooms type 7 (with own toilet): maximum 20% above the specified monthly price per basic room 5) studios: maximum 50% above the specified monthly price per basic room. The maintenance will also be paid monthly on the basis of a monthly cost allowance per room (regardless of the type of room) (Maintenance). Further details will be communicated in the award guidance that will be provided to the selected candidates. The contract assumes that the contractor will realise the Programme of Requirements either by renovating the existing student residence or by demolishing and rebuilding. UGent does not take a position on the manner of execution; demolition of the existing student residence and new construction is permitted, provided that the Programme of Requirements and the contract documents are fully complied with. The choice of the most suitable approach lies entirely with the contractor. Brief description of the contractual obligations of the contractor to be appointed: The contractor will carry out the construction works and all works and orders directly or indirectly related thereto (preparatory works) entirely at his own cost and bears all the risks. In other words, the contractor is exclusively responsible for all actions necessary for the realisation and legal operation of the renovated or newly built student accommodation, including, among other things: - Being responsible for the study and the design (Design) of the construction works. - Drawing up the building permit dossier and applying for the environmental permit and any other permits and authorisations. The contractor is independently and at his own cost responsible for...
