Poland – Parts for aircraft – Dostawa technicznych środków materiałowych, akumulatorów oraz ogumienia do statków powietrznych w 2026 roku

The subject of the contract is the delivery of factory-new, i.e. produced in the year of delivery or the year preceding the year of delivery, technical material means, batteries and aircraft tires in the assortment and quantities specified in the Price Schedule, which is Annex 1 to the SWZ. 2. The Purchaser has divided the subject of the contract into 16 tasks (parts), in accordance with the Price Schedule, which is Annex 1 to the SWZ. 3. The products should meet the quality requirements specified in the technical documentation of the manufacturer for the given product. 4. The Contractor's quality management system must meet the requirements contained in PN:EN ISO 9001:2015. 5. The Contractor provides a warranty for the delivered products for a period of 24 months/200 hours of operation (whichever expires first), from the date of acceptance. 6. The Contractor ensures a total operating period of at least 7 years for the delivered tires (tires and inner tubes). 7. In addition, the Contractor guarantees for the delivered aircraft batteries: - a minimum operating period of 15 months for the batteries on the aircraft; - a minimum storage period of no less than 3 years for the batteries in warehouses; - no restrictions on operation on aircraft under the influence of vertical and horizontal overloads. Additionally, the Contractor guarantees: - for each aircraft battery 12-SAM-28: a set of ventilation/working plugs (12 working + 2 spare with pads), 1 packet (70g) of anhydrous sodium sulphate; - for each individual battery of type: 20KSX-25P, 20FP25H1CT-R, SAFT 26108-7 a minimum quantity of 2 spare cells. The subject cells must be identical to the offered battery. 8. The subject of the contract will be subject to a quality control process in accordance with the provisions set out in the Draft Contract Terms, which is Annex 2 to the SWZ. 9. The products must be preserved for a period of 24 months and in accordance with the provisions set out in the defence standard NO-16-A800:2007. The use of other protection methods than in the defence standard NO-16-A800:2007 is permitted, provided that they ensure equal or better protection. 10. The delivered items, including all its mounting elements etc. (if any), must be appropriately protected against loss of any of their useful values. 11. The requirements set out in AQAP 2131 ed. C version 1 for items 1 to 16 of Annex 1 to the Draft Contract Terms, which is Annex 2 to the SWZ, apply to this contract. 12. At the same time, the Contractor will provide, together with the products in tasks (parts) of the contract 1÷11, 14÷16, a Declaration of Conformity OiB issued in accordance with the Act of 17 November 2006 on the system of conformity assessment of products for the needs of defence and security of the state (Journal of Laws of 2022, item 747, as amended) and indicated in the Regulation of the Minister of National Defence of 11 January 2013 on the detailed list of products subject to conformity assessment and the manner and procedure for carrying out the conformity assessment of products for the needs of the defence of the state (Journal of Laws of 2021, item 1628, as amended) - i.e. in the I conformity assessment procedure. 13. The Purchaser, in accordance with Article 455 of the Pzp Act, allows for the possibility of changing the contract without conducting a new procurement procedure in the cases and on the conditions specified in Section 20 of the Draft Contract Terms. 14. The subject of the contract is the delivery of military equipment, including technical material means, which the Purchaser cannot describe in a sufficiently precise and understandable manner, unambiguously and exhaustively, by specifying sufficiently precise technical or quality parameters, therefore in the Price Schedule, which is Annex 1 to the SWZ, the designations of the products (designation, Part Number, NSN, name) are indicated together with information about the type of equipment of which they are a part, component or equipment with the simultaneous permission to submit equivalent offers in all 16 parts of the contract. 15. In order to meet the requirement arising from Article 99(6) of the Pzp Act, the Purchaser indicates that the criterion serving to assess equivalence will be the permission to use the equivalent product offered for use on specified types of equipment in the equipment of the Polish Armed Forces. 16. The Contractor offering equivalent products is obliged to indicate in section 6 of the Price Schedule, which is Annex 1 to the SWZ, in the individual tasks (parts) of the contract, in the scope of which it offers equivalent products, (name/designation, Part Number, NSN). In the event of non-completion of column 6, the Purchaser will consider that the Contractor is submitting an offer for the subject of the contract indicated by the Purchaser. 17. The Purchaser demands the submission of the subject proof means indicated in Section IV of the SWZ together with the offer. 18. The obligation to submit the subject proof means, referred to in Section IV, point 2 of the SWZ, applies only to Contractors offering equivalent products. In the case of offering products indicated by the Purchaser in the SWZ, the submission of these means is not required. 19. The detailed conditions for the implementation of the contract are specified in the Draft Contract Terms, which is Annex 2 to the SWZ. 20. The Purchaser reserves the right to exercise the right of option. The Purchaser reserves that the contract designated as the "right of option" is an entitlement, not an obligation. The contract under the right of option will be implemented at the unit prices as for the basic contract on the basis of the provisions set out in Annex 1 to the SWZ.
