Poland – Software maintenance and repair services – Zakup usługi subskrypcji oprogramowania do uwierzytelniania i kontroli dostępu dla sieci LAN i WAN wraz ze wsparciem producenta na okres 36 miesięcy

Subject of the Contract: 1.1. The subject of the contract is the provision by the Contractor to the Agency for Restructuring and Modernisation of Agriculture (hereinafter referred to as the "Purchaser") of: 1.1.1. the right to use the Cisco ISE Advantage Subscription for 25,000 endpoints, as specified in Annex 1 to the draft contract terms (hereinafter: "dct"), which is Annex 8.1 to the SWZ. 1.1.2. Software Support for Cisco Identity Services Engine operating on 8 virtual machines, as specified in Annex 1 to the dct, which is Annex 8.1 to the SWZ, under the conditions specified in the Agreement and the general terms of the Software manufacturer. 1.2. The Subscription and Software Support will be valid for a period of 36 months from the date specified in the Protocol for the receipt of the Certificate, as mentioned in § 4(1) of the Agreement, with continuity of operation. 1.3. In order to confirm the entitlement to use the Subscription and Software Support, the Contractor will provide the Purchaser with a Certificate confirming the Purchaser's right to use the Software and indicating the validity period of the Subscription and Software Support, in accordance with the provisions of the Agreement and the general licensing terms of the Software manufacturer. 2. The Purchaser allows Contractors to offer an equivalent solution to that specified in point 1 above, meeting the following requirements. The Contractor 2.1. will supply, configure and launch the IT system and provide the Purchaser with the possibility to use the Software, in accordance with the specification which is Annex 1 to the draft contract terms (hereinafter: “dct-e”), which is Annex 8.2 to the SWZ, including: 2.1.1. will carry out the Implementation on the hardware and application platform at the Purchaser's Location in accordance with the conditions of the dct-e, including agreeing with the Purchaser the Implementation Realisation Schedule, executing and delivering the Technical Project, Test Plan and Implementation Documentation in electronic form; 2.1.2. will carry out the transfer of data (migration) to the Software, which is in the software used by the Purchaser up to the date of conclusion of the Agreement, including defined groups, security policies, user accounts, portals, managed devices and others which are key in the currently operating software. 2.1.3. will provide the Purchaser with the right to use the Subscription, including: 2.1.3.1. the right to use the Software in its current version, including all Software Updates, under the conditions specified in the dct-e and the general terms of the Software manufacturer; 2.1.3.2. the possibility to use the Software Support under the conditions specified in the dct-e and the general terms of the Software manufacturer; 2.1.4. will transfer to the Purchaser the exclusive copyright to the Documentation prepared by the Contractor within the scope of the dct-e, under the conditions, including the fields of exploitation, specified in the Agreement. 2.1.5. will carry out the implementation training for the administrators and users of the Software on the Purchaser's side, in accordance with the conditions of the dct-e; 2.1.6. will carry out the Implementation so that it does not affect the continuity of the Purchaser's IT systems. 2.2. The Subscription will be valid for a period of 36 months from the date specified in the Implementation Protocol, as mentioned in § 4(10) of the dct-e. 2.3. In order to confirm the entitlement to use the Subscription, the Contractor, no later than the Implementation date specified in § 4(1) of the dct-e, will provide the Purchaser with a Certificate confirming the Purchaser's right to use the Software and indicating the validity period of the Subscription, in accordance with the provisions of the dct-e and the general licensing terms of the Software manufacturer. 3. The Purchaser requires that the subject of the contract be executed on the terms and conditions specified in the dct together with the annexes which are Annex 8.1 to the SWZ, and in the case of an equivalent solution being offered, on the terms and conditions specified in the dct-e together with the annexes which are Annex 8.2 to the SWZ.
