Leasing and operation of a passive gigabit broadband network to be constructed in underserved areas of the district of Hameln-Pyrmont

The present notice concerns the award of a service concession (Section 105(1) No 2 GWB, Sections 1 et seq. KonzVgV), where the focus of the procurement is on the operation of a gigabit broadband network and the provision of broadband telecommunications services. The purpose of the service concession is to enable the leasing and operation of a passive gigabit broadband network to be constructed in the expansion area. In this context, reference is made to the exception in Section 149 No 8 GWB.

The district of Hameln-Pyrmont (hereinafter: 'granting authority') intends to lease a subsidised passive gigabit broadband network to a telecommunications company (hereinafter: 'concessionaire' or 'bidder') and to instruct the concessionaire to operate this gigabit broadband network. The concessionaire must operate the gigabit broadband network for at least the minimum operating period of full seven years, after completion of the gigabit broadband network. The concessionaire must equip the passive broadband infrastructure to be constructed by the granting authority with active network components, operate it during the contract period, maintain it at its own expense, and ensure comprehensive, reliable supply of the expansion area and all connection points located there with broadband internet access and corresponding services at market prices, taking into account open access. The granting authority has applied for funding under the "Guideline for the promotion of the gigabit expansion of telecommunications networks in the Federal Republic of Germany" (Gigabit Guideline 2.0) within the scope of the funding subject 3.2 (operator model). The granting authority has also applied for co-financing of the federal funding under the "Guideline on the grant of subsidies for the promotion of the expansion of gigabit networks in grey areas in Lower Saxony" (RL Graue Flecken NI).
