Description
The subject of the contract is the supply of monitors. 2. The contracting authority allows for the possibility of submitting partial tenders, divided into Tasks: 1) Task No. 1 – Supply of monitors; 2) Task No. 2 – Supply of touchscreen monitors. 3. A detailed description of the subject of the contract is Annex No. 5 to SWZ – appropriate for the Task and Chapter XIX of SWZ. 4. The contracting authority requires the tenderer to specify in the Offer the producer and the type, model, assortment symbol or other data unambiguously identifying the offered assortment. In the event that the tender does not specify data unambiguously identifying the offered assortment, the contracting authority will reject the tender on the basis of Article 226(1)(5) of the Act. The term "Producer" shall mean the name of the company under which the offered assortment is sold, or the entrepreneur introducing the goods into circulation in the territory of the Republic of Poland. 5. The contracting authority requires that the offered ICT products do not include: 1) ICT products indicated in the recommendation referred to in Article 34(4) of the Act of 5 July 2018 on the national cybersecurity system, stating their negative impact on the basic interest of the state's security; 2) an ICT product, the type of which has been determined in a decision on the recognition of the supply as a high-risk supplier, referred to in Article 67b(15) of the Act of 5 July 2018 on the national cybersecurity system; Non-compliance with the above requirement will result in the rejection of the tender on the basis of Article 226(1)(17) or (19) of the Act. 6. Information clause regarding the processing of personal data. Pursuant to Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ L 119, 4.5.2016, p. 1), hereinafter referred to as the "GDPR", the contracting authority informs that: 1) the controller of your personal data is the Commander of the Capital Police; 2) supervision over the correct processing of personal data is exercised by the data protection inspector: address: ul. Nowolipie 2, 00-150 Warsaw; e-mail address: [email protected] 3) your personal data will be processed on the basis of Article 6(1)(c) of the GDPR for the purpose related to the procedure for awarding a public contract conducted in the form of an open tender for the supply of monitors ref. no.: WZP-2189/26/117/Ł; 4) the recipients of your personal data will be persons or entities to whom the documentation of the procedure will be made available on the basis of Article 18 and Article 74(1) of the Act; 5) your personal data will be stored, in accordance with Article 78 of the Act, for a period of 4 years from the date of completion of the procedure for awarding the contract, and if the duration of the contract exceeds 4 years, the storage period will cover the entire duration of the contract; 6) the obligation to provide your personal data directly related to you is a statutory requirement specified in the provisions of the Act, related to participation in the procedure for awarding a public contract; the consequences of not providing the specified data result from the Act; 7) with regard to your personal data, decisions will not be made in an automated manner, in accordance with Article 22 of the GDPR; 8) you have: a) the right, pursuant to Article 15 of the GDPR, to access your personal data; b) the right, pursuant to Article 16 of the GDPR, to rectify your personal data; c) the right, pursuant to Article 18 of the GDPR, to request the controller to restrict the processing of your personal data, with the exception of the cases referred to in Article 18(2) of the GDPR; d) the right to lodge a complaint with the President of the Personal Data Protection Office, if you consider that the processing of your personal data violates the provisions of the GDPR; 9) you do not have: a) the right, pursuant to Article 17(3)(b), (d) or (e) of the GDPR, to erasure of personal data; b) the right to data portability, referred to in Article 20 of the GDPR; c) the right, pursuant to Article 21 of the GDPR, to object to the processing of personal data, since the legal basis for the processing of your personal data is Article 6(1)(b), (c) and (f) of the GDPR. 7. The contractor is bound by the tender for 90 days from the expiry of the tender submission deadline, i.e. until 23.11.2026, with the first day of being bound by the tender being the day on which the tender submission deadline expires. 8. The contracting authority, in each Task, in accordance with Article 139 of the Act, provides for a reversed sequence of actions, i.e. may first carry out an examination and evaluation of tenders, and then carry out a substantive qualification of contractors, whose tenders will be the highest rated and obtain positions from 1 to 3 in the tender ranking, in the scope of the lack of grounds for exclusion. 9. The contracting authority - in none of the tasks - does not require the submission of substantive evidence with the tender.
