Rental services for recycling equipment for depths up to 50 cm and in-situ crushing of mineral material with dimensions between 3.1 cm - 31.5 cm for the Production Section - Framework Agreement - 2 years. Minimum estimated value: 222,000.00 lei excl. VAT. Maximum estimated value: 9,990,000.00 lei excl. VAT. Estimated value of the smallest Subsequent Contract: 111,000.00 lei excl. VAT. Estimated value of the largest Subsequent Contract: 3,052,500.00 lei excl. VAT. The minimum and maximum quantities of the framework agreement and the subsequent contracts are in accordance with the Quantity Lists annexed to the Terms of Reference. Subsequent contracts (min 1, max. 3) related to the framework agreement will be concluded based on the equipment needed for the works carried out by the Production Section in-house. The present framework agreement does not constitute the legal basis for the commitment of public funds. Based on this framework agreement, subsequent contracts will be awarded, which constitute the legal basis for payment. Any changes that may occur during the contract period, materialized in revision clauses, in accordance with art. 221 (1) lit. a) of Law no. 98/2016, provided that these fall within the provisions of art. 221 (7) of Law no. 98/2016, i.e., do not constitute a substantial modification in accordance with the contractual clauses of the Framework Agreement and the subsequent contract. Revision clauses cf. art. 221 (1) lit. a) of Law no. 98/2016, which anticipate possible changes that may occur during the execution of the contract are as follows: 1. The parties to the framework agreement / the contracting parties; 2. Unit price. Adjustment of the prices of the Framework Agreement / the price of the subsequent contract – Adjustment of the unit prices; 3. Duration of the subsequent contracts; 4. Quantities; 5. Payment methods and recovery of debts 6. Subcontractors. Third parties; 7. Unforeseeable circumstances, in accordance with the clauses AC (chap. 12) and subcont. (chap. 17). A. In accordance with the provisions of art. 160 (1) of Law no. 98/2016 with subsequent amendments and additions, the deadline by which any economic operator interested in participating in the public procurement procedure has the right to request clarifications or additional information regarding the award documentation is 8 days before the deadline for submission of tenders. B. In accordance with the provisions of art. 160 (2) of Law 98/2016 with subsequent amendments and additions, the Contracting Authority sets a single deadline by which it will respond clearly and completely to all requests for clarification/information in the 6th day before the deadline set for the submission of tenders. *Any request for clarification sent after the date mentioned in point A) will be considered late.
