Subject of the contract is the implementation of the Investment named: Reconstruction of existing buildings within the boundaries of plots along with land development and necessary technical infrastructure, in a design and build system divided into 3 parts, implemented as part of the Project named: „Revival of the Area of the Łódź City Centre (Project 9)” co-financed from EU funds under the programme: „European Funds for Łódź 2021-2027. The contract is divided into 3 parts: 4.1.1. Part 1 – Revitalisation of the tenement house at Piotrkowska Street 50 in Łódź along with land development and necessary technical infrastructure in the „design and build” system, 4.1.2. Part 2 – Revitalisation of the tenement house at Piotrkowska Street 20 in Łódź along with land development and necessary technical infrastructure in the „design and build” system, 4.1.3. Part 3 – Revitalisation of the tenement house at Próchnika Street 6 in Łódź along with land development and necessary technical infrastructure in the „design and build” system. 4.2. Detailed descriptions of the subject of the contract are in Annexes 1a, 1b and 1c to the SWZ and in the model contract constituting Annex 7 to the SWZ (one model for all parts of the procedure). 4.3. The procedure is carried out as part of the Project named „Revival of the Area of the Łódź City Centre (Project 9)” co-financed from EU funds under the programme: „European Funds for Łódź 2021-2027”. 4.4. The contracting authority allows the possibility of the subject of the contract being carried out by the Contractor using subcontractors, whom it is obliged to indicate in section D in part II of its own uniform European single procurement document (JEDZ). 4.5. The Contractor may submit offers for any chosen part(s) of the contract. 8.13. Information on reliance on the resources of the entity providing 8.14. The Contractor may, in order to confirm compliance with the conditions of participation in the procedure, in appropriate situations and in relation to a specific contract, or its part, rely on the technical or professional capabilities or financial or economic situation of entities providing resources, regardless of the legal nature of the legal relations linking it with them. 8.15. The Contractor, who relies on the capabilities or situation of other entities providing resources, submits, together with the offer, a commitment of the entity providing resources to make the necessary resources available to it for the implementation of a given contract or another entity document proving that the Contractor, when implementing contracts, will have the necessary resources of these entities – according to Annex 8 to the SWZ. Based on art. 95 of the Pzp Act, the Contracting Authority requires the Contractor or Subcontractor to employ, on the basis of an employment relationship, persons performing the activities indicated by the Contracting Authority in the scope of the implementation of the contract, if the performance of these activities involves performing work in the manner specified in art. 22 §1 of the Act of 26 June 1974 – Labour Code (Journal of Laws of 2025, item 277 with amendments), i.e. work of all persons performing activities in the scope of general construction, plastering, masonry, flooring, and installation work (sanitary, electrical and low-voltage industry), gardening work in the scope of services related to greenery during the implementation of the contract. 33.2. The type of activities related to the implementation of the contract and the method of verifying the employment of these persons and the Contracting Authority's entitlements in the scope of controlling the Contractor's compliance with the requirements related to the employment of these persons as well as sanctions for their non-compliance have been specified in the description of the subject of the contract (Annex 1a to the SWZ, 1b to the SWZ, 1c to the SWZ) and in the model contract common to all parts of the contract (Annex 7 to the SWZ). 27. INFORMATION ON FUTURE CONTRACTS, AS REFERRED TO IN ART. 214 PARA. 1 POINTS 7 AND 8 OF THE PZP ACT, IF THE CONTRACTING AUTHORITY FORESEES THE AWARD OF SUCH CONTRACTS The Contracting Authority, within 3 years from the date of award of the basic contract, foresees the possibility of awarding contracts, as referred to in art. 214 para. 1 point 7 of the PZP Act, i.e. repetition of the construction contract in individual parts of the contract. Contracts in the above scope will be awarded on the basis of negotiations with the current Contractor, on the terms specified in the basic contract, in the scope of: - general construction works, including demolition, new structural elements/reinforcements, masonry work, joinery, roof, facade, insulation, plastering, flooring, internal joinery, - installation works, including electrical and telecommunication installations, sanitary installations, - finishing works, including finishes and/or equipment, - equipment, - works related to land development and greenery. The possibility of awarding a contract consisting in the repetition of similar services or works on the terms of the Agreement with the Contractor, up to the amount of: - 10 743 644,45 zł net + VAT in Part 1, - 16 720 556,85 zł net + VAT in Part 2, - 10 974 174,91 zł net + VAT in Part 3. The location of the contract consisting in the repetition of similar services or works is identical to the location of the basic contract.
