EnBW Energie Baden-Württemberg AG (Contracting Authority) intends to award the tendering of a cyber insurance programme for the EnBW Group or for the Contracting Authority and the companies affiliated with it in accordance with §§ 15 et seq. AktG. Tenders will be issued separately for the basic contract and the excess contracts. The present tender concerns the conclusion of excess contracts for the provision of cyber insurance cover, which are based on the basic contract ("EU Tender Cyber Insurance Programme - Basic Contract"). The contract period initially amounts to one insurance year from 01.01.2027 00:00, CET, to 01.01.2028 00:00, CET. The contract relationship is extended by one further year with the expiry of the insurance year, provided that it is not terminated by one of the parties in text form at the latest three months before expiry. If a Long Term Agreement (LTA) is concluded, the contract period amounts to two insurance years from 01.01.2027 00:00, CET, to 01.01.2028 00:00, CET, and from 01.01.2028 00:00, CET, to 01.01.2029 00:00. The special provisions of an LTA clause apply in this case. The contract relationship is extended by one further year with the expiry of the insurance year, provided that it is not terminated by one of the parties in text form at the latest three months before expiry of the last insurance year. The Contracting Authority aims for a uniform contract period for all components of the cyber insurance programme. In order to avoid different contract periods within the insurance programme, this aspect will be taken into account in the award decision. The target capacity of the excess contracts above the basic contract of the entire cyber insurance programme is in the three-digit million euro range. The scope of insurance will include standard and special coverage components for cyber risks of large industrial and energy companies.
