France – Gates – SECURISATION DES SITES : ACQUISITION ET INSTALLATION DE BARRIERES, DE PORTAILS, DE TOURNIQUETS, DE CLOTURES ET DE SYSTEMES DE COMPTAGE DE PLACES DE PARKING POUR LES BESOINS DU GROUPEMENT DE COMMANDE COMPOSE DE LA REGIE DES TRANSPORTS METROPOLITAINS, DE RTM EST METROPOLE, DE RTM OUEST METROPOLE, DE TRANSCOOL 13 ET DE TRANSPORTS PAYS DE L’ETOILE (3 LOTS)

This consultation aims to award a procedure for the securing of sites for the purchasing group (decision IV.24.175.02.i) composed of five members, namely: - The Régie des Transports Métropolitains (RTM), acting as the coordinator of the purchasing group in charge of managing the award of the contract; - RTM Est-Métropole; - RTM Ouest-Métropole; - Transcool 13; - Transports Pays de l'Etoile. The consultation is divided into 3 lots as follows: - Lot No. 1: Securing of East Sector Sites - Lot No. 2: Securing of West Sector Sites - Lot No. 3: Securing of Marseille 2 Sector Sites

2/ The present public contracts are awarded according to a negotiated procedure, in accordance with Articles L2124-3, R2124-4 and R2161-21 to R2161-23 of the Code.

3/ Each framework agreement is concluded with a single economic operator and executed: - in part by the issue of purchase orders, for the services described in the contractual documents (under the conditions set out in Articles R2162-13 and R2162-14 of the Code); - and in part by the conclusion of subsequent contracts for needs for which all contractual stipulations are not set out in the framework agreement documents (in accordance with Articles R2162-7, R2162-11 and R2162-12 of the Code).

4/ In accordance with Article R2162-4 of the Code, the public contracts are concluded without a minimum commitment amount and with a maximum commitment amount over their maximum potential duration (8 years), namely: - Lot 1: 10 000 000 Euros excl. VAT; - Lot 2: 10 000 000 Euros excl. VAT; - Lot 3: 10 000 000 Euros excl. VAT.

5/ These are public supply contracts that refer to the General Administrative Clauses applicable to public supply and service contracts (CCAG/FCS), approved by the order of 30 March 2021. This general document, presumed to be known by companies, is not provided in the present file.

6/ The initial duration of each contract is two (2) years from the date of issue of the first purchase order. They are tacitly renewable three times, unless a written decision to the contrary by the RTM, communicated with a 3-month notice before the expiry date, by registered letter with proof of postal delivery. Each renewal has a duration of two (2) years, for a maximum potential duration of eight (8) years.

7/ At the stage of applications, the documents transmitted with the Public Procurement Notice (AAPC) appear in the Consultation Rules "Application Phase" attached as an annex to the AAPC.

8/ Candidates must obligatorily submit their application (and their offer in a later phase) in a dematerialised manner via the site www.achatpublic.com.
