Description
The subject of the contract is the supply of cleaning products and personal hygiene products for the needs of the Government Administration Service Centre for the objects administered by the Government Administration Service Centre located in Warsaw. 2. The detailed manner of implementing the subject of the contract is specified in Annex 1 to SWZ - Draft Contract Terms and Annex 2 to SWZ - Price and Product Form, with the quantities specified in the Form having an indicative nature only. 3. The Contracting Authority reserves the right not to utilise the maximum amount allocated for the implementation of the contract. The subject of the contract may be implemented to a lesser extent, i.e. up to 50% of the value of the funds allocated for implementation. No claims arise for the Contractor in this respect. 4. The Contracting Authority requires that the supplied products and cleaning items are in their original, factory-sealed and undamaged packaging, have the security measures applied by the manufacturer and identifying marks for the assortment. 5. The supplied cleaning products must have a shelf life of at least 12 months from the date of delivery to the Contracting Authority's premises. 6. Whenever trademarks, brand names, patents or origin, as well as standards, are used in the text of the SWZ, including in the description of the subject of the contract, the Contracting Authority allows equivalent assortment, including those marked with other trademarks, brand names, as well as patents or origin, as well as equivalent standards. The equivalent assortment should have features corresponding to the features indicated in the description of the subject of the contract or have better features. 7. The quality of the assortment offered by the Contractor must be the highest and meet the requirements of the Contracting Authority, which in Annex 2 to SWZ - Price and Product Form referred to the brand names of the assortment referring to their high quality, thereby expecting the offer of an assortment with a comparable composition (percentage content of ingredients), while allowing the offer of an equivalent assortment, taking into account the above indication. 8. The Contractor, together with the offer, is obliged to submit documents to meet the requirements specified by the Contracting Authority for the offered deliveries, e.g. product catalog cards or other document, from which it must unambiguously result for the Contracting Authority that the offered subject of the contract has the same or better quality parameters in relation to the subject of the contract specified by the Contracting Authority. Product catalog cards or other documents, from which it must unambiguously result for the Contracting Authority that the offered subject of the contract has the same or better quality parameters, are required only for a product other than the type indicated in the description. 9. In the event of failure to submit or submit defective documents, as referred to in paragraph 8, the Contracting Authority provides for the completion of the above documents. 10. Place of delivery: ul. Powsińska 69/71, 02-903 Warsaw between 8:30 - 13:00, al. Szucha 14, 00-582 Warsaw between 8:30 - 12:00, after prior agreement on the delivery date, time, vehicle brand, registration number and name of the driver, appointed by the Contractor to perform the task, ul. Belwederska 46/50, Warsaw between 8:00 - 10:00. 11. The Contracting Authority does not provide for the award of contracts, as referred to in Article 214(1)(8) of the Pzp Act. 12. The Contracting Authority does not provide for the conduct of an electronic auction, as referred to in Articles 227 - 238 of the Pzp Act. 13. The Contracting Authority does not allow the submission of variant offers, as referred to in Article 92(1) of the Pzp Act. 14. The Contracting Authority does not allow the submission of partial offers. Justification for not splitting the contract: Dividing the contract into parts, and thus delivering cleaning and personal hygiene products by more than one contractor, would be unjustified and irrational. Dividing the contract into parts could increase the cost of implementing the contract, including the increase in costs and labour costs in supervising the implementation of a larger number of contracts, within one subject of the contract. Dividing into parts could also result in difficulties in coordinating the actions of different Contractors implementing individual parts of the contract and threaten the proper and timely implementation of the contract. At the same time, in the opinion of the Contracting Authority, not splitting the contract does not restrict competition by limiting the ability of smaller entities, in particular small and medium-sized enterprises, to bid for the contract. 15. The Contracting Authority does not provide for the conclusion of a framework agreement, as referred to in Articles 311 - 315 of the Pzp Act. 16. The Contracting Authority does not provide for the reimbursement of participation costs, including the reimbursement of costs incurred in obtaining a qualified electronic signature. 17. The Contracting Authority does not allow the submission of offers in the form of electronic catalogues or the attachment of electronic catalogues to the offer. 18. The Contracting Authority may invalidate the procurement procedure if the funds that the Contracting Authority intended to allocate for the financing of the whole or part of the contract have not been granted to it, and the possibility of invalidating the procedure on this basis has been provided for in the contract notice.
