Description

6.1.1.Successive deliveries of 10 units of brand new, low-floor, electric-powered city buses with a total length ranging from 11.5 m to 12.5 m, hereinafter referred to as “EV12 buses”. 6.1.2.Successive deliveries of 10 units of brand new, low-floor, electric-powered city buses with a total length ranging from 17.5 m to 18.75 m, hereinafter referred to as “EV18 buses”. 6.1.3.Successive deliveries, including installation, connection and first start-up of 8 units of brand new Plug-in charging stations with a power greater than or equal to 180 kW, hereinafter referred to as “chargers”. 6.1.4.Warranty and post-warranty service for EV12, EV18 buses and chargers as well as training. 6.2.Common Procurement Vocabulary (CPV): Main Code: 1)34144910-0 electric buses, Additional Codes: 2)34121400-5 low-floor buses, 3)34144910-0 electric buses, 4)34121100-2 public transport buses, 5)31158000-8 chargers. 6.3.Formal requirements that the offered subject of the contract must meet as well as detailed requirements, technical parameters, equipment and warranty and service conditions that the offered subject of the contract must meet and possess include: 1)Annex No. 2.1 to SWZ – concerning EV12 buses, 2)Annex No. 2.2 to SWZ – concerning EV18 buses, 3)Annex No. 3 to SWZ – concerning chargers. The contract has not been divided into lots. Dividing the contract separately for EV12 and EV18 buses and the delivery of chargers would be economically and organisationally ineffective from the perspective of the Buyer. In the case of direct cooperation between the bus manufacturer and the charger manufacturer, compatibility and full interoperability of the bus and charger devices will be ensured, and at the same time, the effect will be the correct supervision of the delivery of chargers, installation work, so as to ensure timely and time synchronisation of the delivery of buses. The implementation of this contract will allow the Contractor to coordinate actions, which will relieve the Buyer of the need to employ persons/specialists with the appropriate and legally required authorisations, whose task would be to control the contractors, settle the terms and other elements of individual contracts. Additionally, there is currently no manufacturer on the market who produces both buses and charging systems, which means that one bus supplier who selects a charging system supplier from the market is the optimal solution for the Buyer, which will result in the best effects from the given outlays, limit the cost of contract execution, and also influence the highest possible level of technical readiness and reliability of the purchased buses and charging systems. The Buyer has been operating electric buses and charging infrastructure for over 10 years. During the previous operation of the buses, the Buyer has repeatedly encountered situations where a bus had to cease operation due to an unidentified fault related to the bus charging process due to a lack of energy in the energy storage of these buses. The lack of contract division minimises the above risks, as one Contractor will analyse the occurring problems and solve them as quickly as technically possible. In view of the above, the lack of contract division is fully justified, purposeful and necessary to apply. 6.4.In accordance with Article 101(4) of the Pzp, in the scope indicated by the Buyer in the description of the subject of the contract and the SWZ requirements or references to standards, European technical assessments, approvals, technical specifications and technical reference systems, as referred to in Article 101(1) and (3) of the Pzp - the Buyer informs that (in each of the indicated cases) equivalent solutions are accepted in this scope. The Contractor who refers to equivalent solutions in relation to the above requirements or references of the Buyer is obliged to prove in the content of the offer to what extent it submits an equivalent offer and is obliged to present in the offer evidence that the supplies or services offered by it meet the requirements specified by the Buyer. 6.4.1.For this purpose, the Contractor will present a list containing, at least: 1)The content of the original requirement defined by the Buyer (references to standards, European technical assessments, approvals, technical specifications and technical reference systems) in relation to which the Contractor submits an equivalent offer. 2)A detailed description of the equivalent solution offered by the Contractor. Additionally, the Contractor will be obliged to submit with the offer evidence confirming the fulfilment (by the equivalent solution offered by the Contractor) of the Buyer's requirements in the form of a certificate issued by a conformity assessment body or a report of tests conducted by that body. The Buyer will also accept other appropriate evidential means submitted by the Contractor, in particular the manufacturer's technical documentation, and in the case where a given Contractor does not have access to certificates or test reports, as mentioned above, or the possibility of obtaining them within the appropriate time, provided that this lack of access cannot be attributed to the given Contractor and provided that the Contractor proves that the supplies or services performed by it meet the requirements, characteristics or criteria specified in the description of the subject of the contract or offer assessment criteria or requirements related to the implementation of the contract. 6.4.2.The Buyer informs that in the event of using in the content of the SWZ, trademarks, patents or origin, source or special process, which characterizes the products or services supplied by a specific Contractor, the Buyer accepts an equivalent solution, provided that the offered subject of the contract has the same or better technical, substantive, user, quality, functional parameters. The Buyer accepts the use of the rest of the part in the SWZ.
