The subject of the contract is the supply of soups, sauces, spices, coffee, tea and natural honey, divided into 9 parts (tasks), in the quantities specified in the price form – Annex 3a to SWZ

2. The requirements and detailed description of the subject of the contract are specified in Annex 1 to SWZ – Description of the Subject of the Contract, which will be placed on the website of the conducted procedure https://platformazakupowa.pl/pn/28wog.

3. The contractor is obliged to implement the contract on the principles and conditions described in Annexes 6, 6A, 6B, 6C, 6D, 6E, 6F, 6G and 6H to SWZ – draft provisions of the contract along with the annexes.

4. The contracting authority provides for the right of option in the subject matter procedure: The contracting authority provides for the right of option in accordance with Article 441 of the Act – Public Procurement Law. The implementation of the right of option - depending on the needs of the contracting authority - will consist in increasing the subject of the contract in accordance with the Description of the Subject of the Contract, up to a maximum of 200% of the value of the basic contract. The contract specified in the optional contract will be implemented by the contractor, with whom the Basic Contract was concluded, on the principles and at the unit prices specified in the basic contract. The contracting authority will inform the contractor to what extent it will be obliged to implement the contract specified in the optional contract. The implementation of the optional part will be carried out on the basis of the contracting authority's statement of will expressed in the form of a written order. The use of the right of option to increase the assortment will apply within the framework of the concluded Basic Contract in the event of the need to ensure the continuity of supply to persons fed. The contractor will be informed of the above with at least a two-week notice. The use of the right of option by the contracting authority is an entitlement of the contracting authority. The use of the right of option by the contracting authority gives rise to an obligation on the part of the contractor to implement the optional contract. In the event of non-use of the right of option by the contracting authority, the contractor has no claims in this respect. The use of the right of option does not constitute a change to the Contract nor does it require the signing of an additional Contract.
