Poland – Passenger cars – Dostawa samochodów służbowych dla Straży Miejskiej Miasta Krakowa

1. The subject of the contract is the "Supply of service vehicles for the Municipal Guard of the City of Krakow", case reference ST.RL.261.27.2026.

2. As part of the contract, the Contractor will supply four vehicles, hereinafter also referred to as vehicles in accordance with the Subject of the Contract Description (SOD) specified in Annex No. 2 to the SWZ.

3. The Contractor provides a full warranty for the vehicles and equipment elements on the terms specified in the contract documents, in particular in the draft contractual provisions (DCP) – contract template, which is Annex No. 8 to the SWZ and in accordance with the submitted offer.

4. The detailed description of the subject of the contract and the scope of the Contractor's obligations have been specified in the annexes to the SWZ, including in the Draft Contractual Provisions and in the Subject of the Contract Description – SOD.

5. The Contracting Authority, in accordance with Article 139(1) of the Pzp Act, provides for a reverse order of procedures, i.e. first conducts an examination and evaluation of offers, and then qualifies the Contractor whose offer has been most highly evaluated in terms of the absence of grounds for exclusion and the fulfillment of the conditions for participation in the procedure. Due to the application of the above procedure, the Contracting Authority does not require the submission of a declaration in the form of the Single European Standard Form (SES) together with the offer. The Contracting Authority requires the submission of this declaration only from the Contractor whose offer has been most highly evaluated.

6. The offer must include the following declarations and documents: a) Offer Form (with the required annexes) and Technical Specification of the subject of the contract – by uploading to the Platform the completed Annex No. 1 and 1a to the SWZ prepared according to the template provided by the Contracting Authority. In the case of submitting an offer on a form other than Annex No. 1 and 1a to the SWZ, it should contain all the required information specified in this annex. The Offer Form and Technical Specification of the subject of the contract do not require completion. b) In the case of Contractors referring to the resources of entities providing resources – Commitment of these entities using the template constituting Annex No. 7 to the SWZ. c) In the case of Contractors jointly applying for the award of the contract – Declaration under Article 117(4) of the Pzp Act using the template constituting Annex No. 4 to the SWZ. d) Declaration/Declarations referred to in Section XVI of the SWZ. e) Extract or information from the National Court Register, Central Information and Business Activity Register or other relevant register – in order to confirm that the person acting on behalf of the Contractor is authorized to represent it. The Contractor is not obliged to submit the above documents, if in the Offer Form it indicates data enabling access to these documents through free and publicly available databases. f) If applicable – Powers of Attorney.

7. The Contractor is obliged to submit the documents referred to in point 6 lit. a-f above through the Platform.

8. The Contractor submits only one offer in accordance with the requirements specified in the SWZ. The content of the offer must correspond to the content of the SWZ.

9. The offer must be prepared in Polish and submitted under pain of invalidity in electronic form or in electronic form via the Platform available at https://strazmiejska-krakow.ezamawiajacy.pl.
