Description
The subject of the contract is the purchase of medical equipment for Copernicus PL Sp. z o.o. The subject of the contract consists of 7 parts: 1) Part No. 1 – Hospital bed (2 tasks), 2) Part No. 2 – Delivery bed, 3) Part No. 3 - Electrocoagulation apparatus, 4) Part No. 4 - Laparoscopic vision tori (2 tasks), 5) Part No. 5 - RTG Arm C apparatus, 6) Part No. 6 - Transport ventilator, 7) Part No. 7 - Laryngological vision tor. 2. The detailed scope of the contract subject, list of devices, quantities and the manner of contract execution are contained in the annexes to the SWZ, namely: 1) Annex No. 1A to SWZ – Price Form, 2) Annex No. 1B to SWZ – Description of the Contract Subject, 3) Annex No. 3A to SWZ – Draft contract for single delivery (regarding parts 3, 6, 7), 4) Annex No. 3B to SWZ – Draft contract for successive deliveries (regarding parts 1, 2, 4, 5). Annex No. 1A and 1B to SWZ the Contractor attaches to the offer. The Contractor, by completing the indicated positions in Annex 1B to SWZ - OPZ, confirms compliance with the requirements specified by the Contracting Authority. 3. The offered contract subjects must be complete, of high standard in terms of both quality and functionality, and free from material, constructional and legal defects. 4. The offered contract subject must be approved for trade and use in accordance with the applicable law. 5. The contract subject must be in accordance with the Act of 7 April 2022 on medical devices (i.e. Journal of Laws 2022.974 of 2022.05.09.). 6. In all entries of the SWZ and its annexes, where trademarks, parameters, sources or a specific process that characterizes the products supplied by a specific contractor of origin (names of manufacturers or devices) are indicated, in accordance with Art. 99 para. 5 and where the subject of the contract is described by reference to standards, technical assessments, technical specifications, reference systems, in accordance with Art. 101 para. 4 of the Pzp Act, the Contracting Authority allows equivalent solutions. In such a case, the Contractor is obliged to prove in the offer, in particular by means of subject-matter evidence, that the proposed solutions meet the requirements specified in the description of the contract subject to an equivalent extent. 7. The Contracting Authority does not reserve the possibility of tendering exclusively by Contractors referred to in Art. 94 of the Pzp Act. 8. The Contracting Authority does not impose requirements referred to in Art. 96 para. 2 point 2 of the Pzp Act. 9. Source of financing of the public contract: The contract relating to parts 5 and 6 the Contracting Authority intends to finance from funds within the grant "Program for the Protection of the Population and Civil Defense for the years 2025-2026". 10. The Contracting Authority reserves the right to invalidate the procurement procedure if the funds from the grant referred to above, which the Contracting Authority intended to allocate for the financing of the contract, are not granted to it.
