This is a negotiated procedure with a participation competition in accordance with § 11 Abs. 1 S. 1 Alt. 2 VSVgV. The subject of the contract to be awarded is the procurement for the delivery and installation of software for the analysis, IT-supported comparison, and research of large datasets in a stock of several partially federated source databases, as well as data imported on an ad hoc basis, in particular from the backups of digital evidence by the Polizei SH. Licenses for 30 simultaneous users are to be procured. Optionally, there should be the possibility to increase the number to up to 75 simultaneous users (that is, in this case, this option must be offered. The procurement of additional licenses (i.e., those exceeding the number 30) is optional for the contracting authority). The licenses should include a term of 3 years from the date of the award (for the 30 licenses, this is the date of acceptance of the system). The contracting authority reserves the right to extend the term up to three times by an additional 12 months each. The bidder is free to offer a temporary transfer of the standard software (rental) or a permanent transfer (sale). The contracting authority uses the EVB-IT-Systemvertrag as the basis for the contractual agreement. This will be made available, together with the other documents, during the tendering phase. The procurement essentially comprises the following services: acquisition of analysis software for the comprehensive analysis, IT-supported comparison, and research of large datasets in the stock of several partially federated source databases, as well as data imported on an ad hoc basis, in particular from the backups of digital evidence by the Polizei SH, which can be installed in an IT environment of a service provider - on premise. This includes a production, development, and test system, which is to be integrated into the existing IT infrastructure of the Polizei SH. Regarding the delimitation of data integration from IT-supported comparison and automated data analysis, reference is made to the attached document "Definition of Terms: Analysis and Data Integration". Further details can be found in the document "Part A - General Part Participation Competition". The procedure concerns a classified contract in accordance with § 104 Abs. 3 Nr. 2 GWB or Art. 2 Buchst. b and d Directive 2009/81/EG and will be carried out in accordance with the VSVgV. Only economic operators established in an EU Member State or in Iceland or Norway ("eligible participants") are eligible to participate (by application and bids) according to the decision of the public contracting authority. Applicants and bidders may not provide subcontractors in their applications and bids who are established in a state other than those mentioned in the previous sentence ("third country"). This also applies to the otherwise invocation of the capacities of such companies. For the determination of establishment, the definition of origin in Art. 3 Abs. 1 of Regulation (EU) 2022/1031 applies accordingly, for economic operators as groups Art. 3 Abs. 2 of the aforementioned regulation.
