A sector dialogue and a market survey have revealed that currently, there is no high-performance gigabit infrastructure with an offer of corresponding telecommunications services available throughout the contracting authority in accordance with the goals of the Gigabit Framework Regulation 2.0, and it will not be available in the coming years. Therefore, the contracting authority has applied for funding for a comprehensive gigabit rollout in the viability gap model under the Directive "Promotion to support the gigabit rollout of telecommunications networks in the Federal Republic of Germany - Federal Gigabit Directive 2.0 (Gigabit-RL 2.0)" of 31 March 2023, as amended by the 1st amendment of 30 April 2024 ("Gigabit-Richtlinie 2.0") and received the notice of the final amount of the grant. The funds provided in this funding program in the viability gap model (hereinafter: funds) are to be passed on by contracting authorities to telecommunications companies in the sense of EU state aid law as investment cost subsidies for the construction and operation of gigabit networks. The same applies to the co-financing according to the Directive of the Free State of Bavaria by the State of Bavaria.
