The subject of the contract is the purchase of a medium-sized fire-fighting and rescue vehicle for the Volunteer Fire Department Zawiercie-Blanowice. 2. Detailed requirements regarding the subject of the contract are specified in the description of the subject of the contract, which is Annex No. 3 to SWZ, and the projected terms of the contract (PPU), which is Annex No. 4 to SWZ. 3. The contractor is obliged to complete the Detailed Subject Offer, which is Annex No. 1A to SWZ. 4. The contracting authority has taken due care to ensure that the subject of the contract has not been described by indicating trademarks, patents, or origin, source, or a particular process, which could lead to the favouring or elimination of certain contractors or products. If, despite this, it turns out that such indications appear in any place in SWZ and in the annexes thereto (contract documents), the contracting authority, in accordance with art. 99(5) of the Act, allows the submission of an equivalent offer in relation to the indications in the Description of the subject of the contract, provided that it ensures the achievement of technical parameters not worse than those assumed in SWZ. 5. Furthermore, wherever in the description of the subject of the contract or other contract documents, the contracting authority has referred to standards, technical assessments, technical specifications and technical reference systems, as mentioned in art. 101(1)(2) and (3) of the Pzp Act, and such references are not accompanied by the expression "or equivalent", the contracting authority, in accordance with art. 101(4) of the Pzp Act, allows equivalent solutions to those described. 6. In the case of the use of materials, devices, products or equivalent solutions, within the meaning of art. 99(5) or art. 101(4) of the Pzp Act, the contractor is obliged to indicate them in the offer and to submit together with the offer technical sheets or other documents confirming that the offered offer or equivalent solutions meet the requirements of the contracting authority specified in the description of the subject of the contract. If the contractor does not submit the above documents or the submitted documents are incomplete (thus not confirming the equivalence of the offer in the scope described in the description of the subject of the contract), the contracting authority will not call for their submission/completion. 7. In the case of a requirement in the Description of the subject of the contract for labels or certificates, the contracting authority accepts all labels confirming that the given supplies or services meet the equivalent requirements of the label specified by the contracting authority and certificates issued by equivalent conformity assessment bodies. 8. The requirements referred to in art. 95(1) of the Pzp Act do not apply in the procedure for a public contract, the subject of which are supplies. 9. The description of the subject of the contract does not require the consideration of accessibility for disabled persons, and no regulations are introduced in the scope of art. 100(1) of the Pzp Act. 10. Additional information: The description of the offered vehicle should be submitted together with the offer, in accordance with the template constituting Annex No. 1A to SWZ - Detailed Subject Offer, as the services specified therein, which will be fulfilled in the event of the offer being chosen as the most advantageous, constitute the content of the offer. However, the content of the offer consists only of those items in the "Detailed Subject Offer" in which the contractors must not only confirm the compliance of the parameters of the offered device with the minimum requirements of the contracting authority - on the basis of "Meets/Does not meet", but also provide the year of production of the chassis, the year of production of the body, the type, model of the chassis, the power of the engine used in order to identify it unambiguously and/or specify the sizes of the technical parameters or features of the offered vehicle. The specification of these information is essential for the contracting authority to conduct the procedure and constitutes the content of the offer. Therefore, the failure to submit the Detailed Subject Offer by the date of submission of offers, or the failure to complete, or the incorrect completion of the Detailed Subject Offer, making it impossible for the contracting authority to identify the offered vehicle, or the inability to establish: whether the offered vehicle meets the minimum technical requirements referred to in the template constituting Annex No. 1A to SWZ, will result in the absolute rejection of the offer, on the basis of the provisions of art. 226(1)(2) lit. c) and/or art. 226(1)(5) of the Pzp Act. However, those items in the Detailed Subject Offer in which the contractors must only confirm the compliance of the parameters of the offered vehicle with the minimum requirements of the contracting authority on the basis of: "Meets/Does not meet" (without the need to specify information), do not have the character of the content of the offer, but constitute a substantive means of evidence to confirm that the offered supplies meet the requirements, features or criteria specified by the contracting authority, as referred to in art. 106(1) of the Pzp Act. In view of the above, if the original description of the offered vehicle (Detailed Subject Offer) in the items: "Meets/Does not meet" turns out to be incomplete or unclear, the contracting authority will call on the contractor to submit or supplement the Detailed Subject Offer, but only in the part covering exclusively those items: "Meets/Does not meet", which were completed incorrectly by the contractor on the date of submission of offers, or were not completed at all. However, it is not permissible to submit or supplement, after the deadline for submission of offers, the description of the offered equipment (Detailed Subject Offer) in the part constituting the content of the offer, if it were to serve to supplement the information not originally provided, or to change the originally specified sizes of the technical parameters, or features of the offered vehicle.
