The contract may be awarded to Contractors who meet the following conditions:

1) Capacity to operate in the market: The Purchaser does not set a condition in this regard.

2) Authorisation to carry out a specific economic or professional activity, where this results from separate provisions: The Purchaser does not set a condition in this regard.

3) Economic or financial situation: The Purchaser will consider the above condition to be met if the contractor proves that it has an implemented quality management system (ISO 27001 and ISO 11799 certificate or equivalent). In the case of contractors tendering jointly for the award of the contract, the above condition must be met by those contractors who will carry out the activities for which the above experience is required.

4) Technical or professional capacity: The Purchaser will consider the above condition to be met if the contractor proves that, in the last 3 (three) years before the deadline for submitting tenders, or if the period of activity is shorter – in this period, it has properly carried out or is carrying out at least two services of archival document storage category B with a value of not less than 500,000.00 PLN each, and that these services have been or are being carried out properly. In the case of contractors tendering jointly for the award of the contract, the above condition may be met jointly by the contractors. In the case of contractors tendering jointly for the award of the contract, the above condition must be met by those contractors who will carry out the activities for which the above experience is required.

In the event that any value relating to the above conditions is expressed in a foreign currency, the Purchaser will convert that value based on the average exchange rate of the National Bank of Poland (hereinafter: NBP) for the given currency on the day on which the subject procedure is published. If the average NBP exchange rate is not published on that day, the Purchaser will accept the average rate from the last day before the publication date.

The assessment of the fulfilment of the conditions for participation in the procedure will be carried out on the basis of fulfilment/non-fulfilment, based on the contractor's declaration submitted, as referred to in Article 125(1) of the Pzp Act, and the subject evidence required in the procedure.
