The service involves daily preparation, delivery and handing over of approximately 455 daily meals (breakfast, lunch, dinner, night meal) called meals, as well as the collection and disposal of post-consumption waste in 3 locations of the Dolnośląskie Centrum Onkologii, Pulmonologii i Hematologii (DCOPiH): 1) pl. Hirszfelda 12 Wrocław - current location 2) ul. Grabiszyńska Wrocław - current location 3) ul. Hipokratesa 2 Wrocław - future location after relocation of current locations. Pursuant to Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter "GDPR"), I inform you that: 1. The controller of your personal data is Dolnośląskie Centrum Onkologii, Pulmonologii i Hematologii, pl. Hirszfelda 12, hereinafter referred to as the Controller/ADO. 2. The Controller has appointed a Data Protection Officer, whom you can contact by e-mail at [email protected] or in writing to the Controller's registered office. The Data Protection Officer can be contacted regarding all matters related to the processing of personal data and the exercise of rights related to data processing. 3. We will process your personal data for the purpose of conducting the subject procurement procedure for the award of a public contract pursuant to Article 6(1)(c) of the GDPR (performance of a legal obligation incumbent on the controller). 4. The recipients of your personal data will be persons or entities to whom the documentation of the procedure will be made available pursuant to Article 18 and Article 74 of the Pzp Act. 5. Your personal data will be stored for a period of 5 years for documents created under national public procurement contracts, and for 10 years for Union public procurement contracts. However, civil law contracts together with documentation related to their implementation, regardless of the manner in which they were concluded, will be stored for a period of 10 years. 6. The obligation to provide your personal data directly concerning you is a statutory requirement specified in the provisions of the Pzp Act, related to participation in the procedure for the award of a public contract; the consequences of not providing the specified data result from the Pzp Act. 7. In relation to your personal data, decisions will not be made in an automated manner. 8. You have: • the right, pursuant to Article 15 of the GDPR, to access your personal data; • the right, pursuant to Article 16 of the GDPR, to rectification or completion of your personal data, whereas the exercise of the right to rectification or completion may not result in a change to the outcome of the procedure for the award of a public contract or a change to the provisions of the contract for a public contract in a manner inconsistent with the Pzp Act and may not infringe the integrity of the protocol of the procedure and its annexes; • the right, pursuant to Article 18 of the GDPR, to request the controller to restrict the processing of personal data with the reservation of cases referred to in Article 18(2) of the GDPR, whereas the right to restrict processing does not apply in relation to storage, for the purpose of ensuring the use of legal protection measures or for the protection of the rights of another natural or legal person, or on the grounds of an important public interest of the European Union or a Member State, and also does not restrict the processing of personal data until the completion of the procedure for the award of a contract; • the right to lodge a complaint with the President of the Personal Data Protection Office, if you consider that the processing of your personal data infringes the provisions of the GDPR; you do not have: • the right, pursuant to Article 17(3)(b), (d) or (e) of the GDPR, to erasure of personal data; • the right to data portability, referred to in Article 20 of the GDPR; pursuant to Article 21 of the GDPR, the right to object, to the processing of personal data, as the legal basis for the processing of your personal data is Article 6(1)(c) of the GDPR. 6.3. The power of attorney must be submitted in original form in the same form as the submitted offer (in electronic form). It is also permissible to submit an electronic copy (scan) of the power of attorney previously prepared in written form, in the form of an electronic certificate prepared in accordance with Article 97(2) of the Act of 14 February 1991 on Notaries, which certificate the notary certifies with a qualified electronic signature, or by certifying the scan of the power of attorney previously prepared in written form with the qualified electronic signature of the grantor. An electronic copy of the power of attorney may not be certified by the attorney. For this power of attorney, in accordance with Article 1(1)(2) of the Act of 16 November 2006 on the tax (i.e. Journal of Laws 2015 item 783 as amended), no fee is required (if applicable). 6.4. Subject evidence - the Purchaser does not require. 2.10 The Purchaser envisages orders, referred to in Article 214(1)(7) of the Act, in the event that the current contractor is awarded the basic order, an order consisting of the repetition of similar services. The scope of the above orders will cover the collective catering service or meal distribution, and the value of the additional order will not exceed 50% of the value of the basic order.
