Germany – Pharmaceutical products – Open-House-Rabattverträge 2024-09

The health insurance funds (whether HEK and/or hkk participate in the respective lot is determined by the designation of the respective lot) aim to conclude rebate agreements under § 130a para. 8 SGB V with all suitable pharmaceutical companies for the active substances, active substance combinations, or dosage forms, strengths, or finished medicinal products specified in the respective lot. The medicinal products subject to the contract are, unless the contract provides otherwise, always all interchangeable finished medicinal products of the contracting partner under the framework agreement on the supply of medicinal products under § 129 para. 2 SGB V. The contract is concluded under the Open-House procedure: Individual negotiations on contract terms are not conducted, and uniform conditions apply. The health insurance funds do not guarantee exclusivity to individual contracting partners. The contract term is a maximum of 24 months, starting at the earliest on 01.09.2024 (any deviations in start times are determined by the information for the corresponding lot). The contract ends at the latest on 31.08.2026 (any exceptions are determined by the information for the corresponding lot), regardless of the date of contract conclusion. Joining this Open-House procedure is possible at any time during the contract term. All further information can be found in the participation and contract documents.
