The subject of the public contract performance is project activities. The contract is not divided into parts (the contracting authority does not allow partial performance). The subject of the public contract performance are services consisting of the preparation of project documentation for the subsequent implementation of the project "Louky pod loukou" in the locality in the immediate eastern vicinity of the national cultural monument Louckého kláštera. The aim is to transform this predominantly fallow space into a place with high recreational potential. The locality should become a place for daily recreation, active rest and sports for both adults and children, all while preserving the natural character. The locality requires significant revitalization. In addition to public greenery, other leisure activity elements should also be added. The estimated investment costs of the construction are approximately 106 million Kč excluding VAT. The basis for the preparation of the project documentation is the territorial study, which forms Annex No. 1 of this tender documentation. The project documentation will be divided into designated phases according to the processed study, including separate budgets, so that it would be possible to implement the project gradually in individual phases. The subject of the performance are particularly the following outputs and activities:

1. Preparation of project documentation for the purpose of the building permit (DPZ), which will contain all the documents necessary for the issuance of the building permit in the documentary part. The DPZ will also include negotiations with all DOSS (affected bodies of state administration) and pre-project preparation including all necessary building and technical surveys (e.g. geological and geotechnical survey, hydrogeological survey, etc.) and other additional measurements, which will lead to the flawless preparation of the work. The documentation for the purpose of the building permit must, in terms of content, meet the requirements of Act No. 283/2021 Coll., the Building Act, as amended by later regulations ("Building Act"), Decree No. 146/2024 Coll., on requirements for construction and Decree No. 131/2024 Coll., on building documentation, all in the current version. The scope of the individual parts of the documentation must correspond to the type and significance of the investment intention, its location, building and technical execution, purpose of use, impact on the environment and the duration of the construction. Performance of related engineering and investment activities (especially ensuring the opinions of affected bodies of state administration, network owners, etc.). The performance of engineering and investment activities includes, on the part of the supplier, the negotiation of project documentation for the building permit procedure with the affected bodies and organizations of state administration, i.e. ensuring the opinions for the issuance of the building permit, submitting an application to the building authority and obtaining the building permit including legal force.

2. Preparation of project documentation for the implementation of the construction including a list of works, supplies and services including a schedule of quantities (documentation for the selection of the construction contractor) (hereinafter also referred to as "PDPS"), which will be used in the tendering procedure according to ZZVZ and the relevant implementing legal regulations and which contains in particular the requirements according to the valid and effective legislation, relating to its content to the subject of the performance, in particular the Building Act, related legal regulations, a detailed list of construction works, supplies and services with a schedule of quantities divided into individual construction objects and operational units and phases, also including ancillary and other costs according to Decree No. 169/2016 Coll., an evaluated list of construction works, supplies and services – itemised budget with the use of aggregated (cumulative) items for repeated large-volume items with a breakdown of content, the itemised budget must be prepared in such a way that its items are linked to the selected price system to the maximum extent. PDPS must be suitable to form part of the tender documentation for a public contract for construction works in the details necessary for the preparation of a tender for a public contract, i.e. in the detail required by ZZVZ and its implementing regulations, in particular Decree No. 169/2016 Coll., on the scope of documentation for a public contract for construction works and a list of construction works, supplies and services with a schedule of quantities, as amended by later regulations. In particular, the provisions of Section 36(1) ZZVZ (prohibition of setting tender conditions in such a way as to guarantee certain suppliers directly or indirectly an unfair competitive advantage or to create unfair obstacles to economic competition) and Section 89(5) ZZVZ (prohibition of setting technical conditions in such a way as to favour or disadvantage certain suppliers or products; prohibition of references to specific products) must be taken into account.

3. Provision of an exclusive license to use the project documentation according to Act No. 89/2012 Coll., the Civil Code, as amended by later regulations (hereinafter also referred to as the "Civil Code"), and Act No. 121/2000 Coll., on copyright, rights related to copyright and on the amendment of certain acts (Copyright Act), as amended by later regulations (hereinafter also referred to as the "Copyright Act"), i.e. unrestricted consent to the use of the work, so that the contracting authority is entitled to deal with the work freely, according to its own discretion and without restriction.

4. Provision of cooperation and technical assistance in the tendering procedure for the construction contractor according to ZZVZ. During this phase, the supplier will ensure that the contracting authority receives answers to queries from participants relating to the project documentation as part of the explanation of the tender documentation during the implementation of the tendering procedure for the selection of the construction contractor according to ZZVZ. The contracting authority will forward the participants' queries, i.e. requests for explanation of the tender documentation, relating to the project documentation, to the supplier in electronic form, the supplier will process the expert answers to the participants' queries, i.e. submit the explanation of the tender documentation no later than 3 working days regardless of the scope and complexity of the subject matter and send it to the contracting authority in electronic form.

5. Performance of author's supervision during the implementation of the construction on the basis of the project documentation according to Section 14 letter h) and Section 161(2) of the Building Act (hereinafter also referred to as "Performance of author's supervision").
