This notice is for concluding agreements with pharmaceutical companies in accordance with Section 130a (8) sentence 1 of the German Social Code (SGB V). The invitation to participate is directed solely at pharmaceutical companies or associations of employees of pharmaceutical companies in accordance with Section 4 (18) of the German Medicines Act. This is not an open procedure in accordance with Section 15 of the German Act on the Award of Public Contracts (VgV) in conjunction with Section 119 (3) of the German Act against Restraints of Competition (GWB), but a publication of the invitation to conclude/join rebate agreements with conditions, including the amount of the rebate, that are fixed and non-negotiable for all participants. There can be an unlimited number of pharmaceutical companies or associations of employees of pharmaceutical companies in accordance with Section 4 (18) of the German Medicines Act as contracting partners.
