Poland – Processed fruit and vegetables – 86/2026 Dostawa warzyw kwaszonych do jednostek wojskowych i ośrodków szkolenia poligonowego

1. The subject of the contract is the successive delivery of pickled vegetables to military units and training center ranges in accordance with the assortment-quantity list contained in Section IV – "Description of the contract" of the SWZ and in the "Tender Form" attached as Annex 1 to the SWZ. 2. According to Article 441(1) of the Pzp Act, the Purchaser envisages the possibility of exercising the "Right of Option". The "Right of Option" will be exercised on the same terms and conditions and within the same deadlines as the main contract. In the event that the Contractor does not exercise the "Right of Option", with regard to the scope of undelivered supplies specified in the tables in Section IV of the SWZ, in the column named "quantity in option", no claims shall arise against the Purchaser, including in particular claims for payment of expected benefits. The "Right of Option" means that the final quantity of the subject of the contract will depend on the Purchaser's current needs. The Purchaser will inform the Contractor of the intention to exercise the "Right of Option", together with the quantity of the subject of the contract and the place of its delivery, within the deadline specified in the "Draft Contract Terms" attached as Annex 5 to the SWZ. 3. The Purchaser does not allow the use of substitute packaging for food products that are the subject of the procedure during the execution of the contract. 4. The Contractor is obliged to notify the Purchaser in writing of any change in the occurrence of allergens in the delivered products. 5. The Contractor is responsible for ensuring the safety and proper hygiene of food products, with particular regard to the applicable legal provisions. 6. The Purchaser has described the subject of the contract by reference to standards. The Purchaser therefore indicates that it allows solutions equivalent to the described standards.
