The subject of the Public Procurement is the conclusion of (i) a framework agreement according to § 131 of the Act between the contracting authority and the selected supplier (hereinafter referred to as the “Framework Agreement”). The subject of the Framework Agreement is the arrangement of the procedure for concluding individual purchase contracts (hereinafter referred to as “Purchase Contracts” or individually as a “Purchase Contract”) (i) for the production and delivery of up to 33 units of • electric units designated as EMU145 (up to 13 units); and • battery electric units designated as BEMU145 (up to 20 units), for the 25 kV/50 Hz AC and 3 kV DC system, fully capable of operation on railway tracks with a gauge of 1 435 mm on the territory of the Czech Republic (hereinafter referred to as “Units” or individually as a “Unit”), including all permits, approvals, consents and registrations (“registrations” in this tender documentation means all registrations having a character similar to a permit, approval or consent), which are valid according to the legislation on the date of delivery of the respective Unit to the contracting authority, necessary for the operation and use of the delivered Units (mutually compatible and communicating) and which will allow the contracting authority to operate and use the Units properly and without restriction on the territory of the Czech Republic and further including the technical documentation pertaining to the respective Units in the scope set out in the Framework Agreement and in the respective Purchase Contract; and/or (ii) the supply of spare parts and structural assemblies of the exchangeable system (“exchangeable system spare parts”).
