Description

The subject of the contract are forestry services in accordance with the definition in art. 6, section 1, point 1 of the Act of 28 September 1991 on Forests (consolidated text: Journal of Laws of 2026, item 663 – “Forest Act”), including works in the field of forest cultivation and protection, fire protection, timber harvesting and extraction, as well as forest nurseries and seed production, to be carried out in the Szczebra Forest District in 2027. 1. The material scope of the contract subject covers the summary quantities of works in the field of forest cultivation and protection, forest fire protection, timber harvesting and extraction, as well as forest nurseries and seed production, resulting from Annex No. 2 to the SWZ. The quality standards relating to all the essential features of the contract subject are specified in Annex No. 3 to the SWZ. 2. The Contracting Authority envisages the possibility of awarding contracts, as referred to in art. 214, section 1, point 7 of the PZP, within a period of 3 years from the date of awarding the main contract. These contracts will involve the repetition of services consistent with the services that are the subject of this contract, as well as services similar to them in terms of the technological aspect of their execution. The material scope of these services will not exceed 50% of the value of this contract. 3. The subject of the contract has been divided into 5 parts ("Packages"): Package I – forestries: Lipki, Dębiny and Przewięź, Package II – forestries: Busznica and Nowinka, Package III – forestries: Blizna and Klonownica, Package IV – forestries: Koniecbór and Masalszczyzna, Package V – forestries: Szkółki, Młynisko, Jaśki and Topiłówka. 4. The Contracting Authority, in accordance with art. 95 of the PZP, requires the Contractor or subcontractor to employ, on the basis of an employment relationship, persons performing tasks in the field of implementing the contract, involving the harvesting and extraction of timber, if the performance of these tasks involves work as defined in art. 22, section 1 of the Act of 26 June 1974 Labour Code (consolidated text: Journal of Laws of 2023, item 1465 with later amendments). 5. The place of implementation of the contract subject will be the administrative area of the Szczebra Forest District. The implementation of works constituting the contract subject for individual Packages will take place in the area of the forestries – appropriate for a given Package ("Package Implementation Area"). The location (forest address) of individual forest works included in the Contract Subject, as indicated in the annexes constituting Annex No. 2, is preliminary. The location (forest address) of individual works included in the Contract Subject will be specified in the Order, with the proviso that it will always be the Package Implementation Area. 6. With regard to each Package, the Contracting Authority is entitled to commission the Contractor with an additional material scope in relation to each of the positions of the Bill of Quantities forming part of the Offer ("Option"). The subject of the Option will be the same (analogous) works as described in the SWZ and priced by the Contractor in any of the positions of the Bill of Quantities forming part of the Offer. As part of the Option, at the discretion of the Contracting Authority, all, some or only one of the works indicated in the SWZ and priced by the Contractor in the Bill of Quantities forming part of the Offer may be commissioned. Works that are the subject of the Option may be commissioned in a quantity whose total value will not exceed 30% of the Remuneration from the date of conclusion of the Contract, in accordance with §11, section 1, 2 of the contract template constituting Annex No. 12 to the SWZ. The basis for determining the value of works commissioned within the scope of the Option (in order to determine its scope) will be the unit prices of individual works included in the Bill of Quantities forming part of the Offer. With regard to each Package, the Contracting Authority is entitled to commission the Contractor with a material scope smaller in relation to each of the positions of the Bill of Quantities forming part of the Offer ("Option"). The Contracting Authority is not obliged to commission works covered by the subject of the Option, and the Contractor does not have a claim for their commissioning. The Contracting Authority envisages the possibility of using the Option in the event of: (1) the occurrence of a need to increase the material scope of services constituting the subject of the contract as a result of natural, climatic, atmospheric causes or related to the proper conduct of forest management, (2) changes in the timber sales market or the assignment of new economic or public tasks to the Contracting Authority, (3) the assignment of works to the Contractor constituting substitute execution in relation to works carried out by another contractor (in the Package Implementation Area).
