Poland – Refuse and waste related services – Odbiór i zagospodarowanie odpadów komunalnych od właścicieli nieruchomości z terenu gminy Radłów, na których zamieszkują mieszkańcy oraz z PSZOK w Radłowie, w okresie od 01.01.2027 r. do 31.12.2027 r.

3.1. The subject of the contract is the collection and disposal of the municipal waste indicated in the Subject of the Contract Description from the owners of the properties where the inhabitants of the territory of the Gmina Radłów live, as well as from the Selective Waste Collection Point in Radłów, in a manner that ensures the achievement of appropriate levels of recycling, preparation for reuse and recovery by other methods, and the limitation of the levels of the mass of biodegradable municipal waste transferred for disposal in accordance with the applicable regulations. The subject of the contract must also be implemented in accordance with the provisions of the Act of 14 December 2012 on waste (i.e. Journal of Laws of 2023, item 1587 as amended), the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (i.e. Journal of Laws of 2025, item 733), the provisions of the current Voivodeship Waste Management Plan, as well as the provisions of the Regulations for maintaining cleanliness and order in the territory of the Gmina Radłów, and other generally applicable and local legal provisions – in the wording current on the day of the implementation of the contract. 3.2. The detailed description of the subject of the contract is specified in the Subject of the Contract Description - Annex No. 1 to the SWZ and in the Draft Contract Clauses – Annex No. 3 to the SWZ. 3.3. The quantity of waste specified in the Tender Form is the maximum quantity (i.e. 2,700 Mg). The Contracting Authority reserves the right to reduce the scope of the contract being implemented, which is equivalent to the incomplete use of the quantity resulting from the Tender Form. The actual quantity of waste for collection may differ from the specified quantity and will depend on the actual demand of the Contracting Authority. The minimum scope of the contract implemented by the Contractor will not be less than 80% of the maximum total quantity of waste provided for in the Tender Form. 3.4. Contract with the right of option: 3.4.1. The scope of the basic contract is the quantity of waste in Mg/year specified in the Tender Form (i.e. 2,700 Mg). The Contracting Authority envisages the possibility of exercising the right of option in the scope of up to a maximum of 10% increase in the collection and disposal of the quantity of waste specified in the Tender Form. 3.4.2. The right to exercise the option will be related to the current needs of the Contracting Authority regarding the necessity of collecting and disposing of a larger quantity of waste than the quantity of waste provided for in the Tender Form, resulting from the quantity of waste generated. 3.4.3. In order to activate the option, the Contracting Authority will submit to the Contractor, in writing, a declaration in which it expresses its intention to exercise the right of option and specifies the scope in which it exercises the right of option. The submission of the declaration will take place no later than 14 days before the deadline for the implementation of the service covered by the right of option. In the event of exercising the right of option, the Contracting Authority will submit to the Contractor the declaration referred to in the first sentence, no later than 30 days before the end of the implementation of the contract covering the scope of the basic contract. 3.4.4. In the scope of the optional contract, the Contractor is obliged to commence the provision of the service on the basis of the written declaration of the Contracting Authority regarding the exercise of the right of option. 3.4.5. The exercise of the right of option by the Contracting Authority may be made once for the entire value of the optional contract or in several parts. In the case of implementing the option in several parts, the Contracting Authority will submit to the Contractor subsequent declarations no later than before the moment of exhaustion of the maximum scope resulting from the right of option. 3.4.6. The Contracting Authority reserves that the contract covered by the right of option will be implemented on the conditions of the basic contract, in accordance with the provisions of this SWZ together with the annexes and the offer of the Contractor. 3.4.7. In the event of the Contracting Authority exercising the right of option, the Contractor is entitled to remuneration for the actual quantities of municipal waste collected and disposed of. The remuneration of the Contractor for the implementation of the service covered by the right of option will be calculated on the basis of the provisions of the contract and on the basis of the unit price indicated by the Contractor in the offer. 3.4.8. The right of option is a unilateral entitlement of the Contracting Authority, which may, but is not obliged to, exercise it within the framework of the implementation of the subject of the contract. In the event that the Contracting Authority does not exercise the right of option, the Contractor has no claims in this regard. 3.4.9. The exercise of the right of option by the Contracting Authority does not require the preparation of an annex to the contract.
