Description

This procedure aims to acquire services for DESIGN AND TECHNICAL ASSISTANCE FOR REHABILITATION/ SYSTEMATISATION/OPTIMISATION OF THE NATURAL GAS DISTRIBUTION/DEVIATION NETWORK and NEW NATURAL GAS DISTRIBUTION CONNECTIONS, as described in the terms of reference – part of the award documentation. Any interested economic operator has the right to request clarifications or additional information regarding the award documentation. To the extent that clarification requests are received at least 18 days before the deadline for submission of tenders, the contracting entity will respond clearly and completely to all these clarification requests by the 11th day before the deadline for submission of tenders. Review clause according to art. 236 of law no. 99/2016: 1) Given that the award documentation contains a minimum set of specific information relating to estimates of the min./max quantities that may be requested during the framework agreement, as well as estimates of the min./max quantities that may be the subject of a single subsequent contract among those that are to be awarded during the framework agreement, we emphasize the fact that these min./max quantities that the contracting entity initially establishes in the award documentation and subsequently in the framework agreement represent estimates of quantities that may be requested during the entire framework agreement and not the exact quantities that will be procured, the latter being able to be smaller, equal to or greater than the estimated ones, depending on the real needs of the contracting entity. In this sense, taking into account the fact that the effects of the framework agreement mainly aim to establish the terms and conditions governing the sectoral procurement contracts that are to be awarded in a certain period, especially with regard to the unit price and, where applicable, the quantities taken into account, the Promitent-Achizitor reserves the right/option to supplement the estimated quantity at the level of the award documentation with up to a maximum of 50% of the max estimated quantity for the AC, or with up to 50% of the quantity of a subsequent contract. The price of the services that will be additionally procured on the basis of the review clause will be that of the financial proposal on which the AC (adjusted where applicable, according to the adjustment formula)/subsequent contract is based, period of time during which this option can be used by the Promitent-Achizitor: for the entire validity period of the framework agreement/subsequent contract. The modification of the framework agreement on the basis of the present review clause is limited to non-substantial modifications regulated by art. 240 para. (1), lit. a) of Law no. 99/2016, having all the elements provided for in art. 2 para. (1)-(2) of ANAP Instruction no. 1/2021. Taking into account the above review clause, the estimated value of the procedure has been expressed in the form of an interval - the minimum value of the interval representing the estimated value of the present procedure on the basis of which the tenders will be evaluated, and the maximum value representing the estimated value that includes the value of possible supplements on the basis of the review clause). 2) To the extent that the maximum estimated quantity (including taking into account the review clause from point 1) is not reached during the 4-year period, the contracting entity reserves the right to extend the validity period of the framework agreement, but not more than the period at which the maximum estimated quantities will be reached. 3) Each rehabilitation/systematisation/optimisation/establishment of a natural gas distribution system, medium and low pressure without branches, may include at least 1 road quality technical expertise at the level of re-offering, if during the execution of the subsequent contract/commands the need arises to carry out more than 1 expertise, the number of road expertises will be added to the unit price offered within the re-offering process.
