The subject of this order is the purchase of 10 fully equipped ambulances. The detailed description of the subject of the order is specified in Annex No. 2 to the Specification of Order Conditions. The subject of the order is free from physical and legal defects, factory new, not previously used by third parties, in particular, it has not served as a used item for demonstration purposes and is of good quality. It has also not been previously refurbished. The medical products offered and subject to the order must meet the requirements specified in the Act of 7 April 2022 on medical devices (i.e. Journal of Laws of 2024, item 1620). The labeling of the delivered materials, user instructions, and product descriptions must be prepared in the Polish language. The Contractor undertakes to execute the subject of the order in accordance with all the requirements of the Ordering Party indicated in the SWZ. The Contractor is obligated to submit an offer for the entire subject of the order, taking into account all positions. All requirements specified in the order documents constitute minimum requirements, and their fulfillment is mandatory. Failure to meet the above minimum requirements will result in the rejection of the offer as non-compliant with the order conditions, pursuant to Article 226, paragraph 1, point 5, of the Pzp Act. If the Ordering Party, in the description of the subject of the order, indicates trademarks, patents, or origin, sources, or a specific process that characterizes the products or services supplied by a specific Contractor, equivalent solutions to those described are permitted, provided that they maintain the same minimum technical, quality, and functional parameters. In cases where the description of the subject of the order contains references to standards, technical assessments, technical specifications, and technical reference systems, as referred to in Article 101, paragraph 1, point 2, and paragraph 3, of the Pzp Act, the Ordering Party permits equivalent solutions to those described. The Contractor who refers to equivalent solutions is obligated to demonstrate that the solution offered by them meets the requirements specified by the Ordering Party. In such a case, the Contractor attaches to the offer a list of equivalent solutions along with their description or standards.
