Poland – Refuse and waste related services – „Odbiór odpadów komunalnych od właścicieli nieruchomości z terenu Gminy Legnica”

The subject of the contract is the "Collection of municipal waste from property owners in the area of the Municipality of Legnica, delivery to properties of containers and bags for municipal waste as per the annex to the OPZ, as well as maintenance of containers in an appropriate sanitary, orderly, and technical condition. The estimated amount of waste for the period from 01.12.2026 to 30.11.2027 is 36,708.00 Mg. The place of the waste collection service covers the area of the city of Legnica. Collection of municipal waste: non-segregated mixed, paper, glass, metals and plastics, as well as bio-waste, bulky waste, used electrical and electronic equipment, tyres, and at least 2 times a year textiles (in the voucher system). The subject of the contract includes: 1) collection of municipal waste from properties where residents live, 2) collection of municipal waste from properties where residents do not live, but where municipal waste is generated, 3) collection of municipal waste from properties where residents live in part and from properties where residents do not live in part, but where municipal waste is generated, 4) the above collections will take place both from containers and bags owned by the property owner and from containers and bags delivered as part of the service by the Contractor, 5) organisation of the collection of bulky waste, used electrical and electronic equipment, and tyres, as well as, at least 2 times a year, textile waste 6) organisation of the selective collection of expired medicines along with their collection from confiscators owned by the Contracting Authority, used for collecting expired medicines located in pharmacies in the city of Legnica – including the provision of cardboard inserts with bags and maintenance of the confiscators in good technical condition, 7) delivery to single-family housing of containers or bags for municipal waste 8) delivery to multi-family housing of containers for municipal waste The Contractor is obliged to comply with the law during the execution of the contract, in particular such as: a) the Act on maintaining cleanliness and order in municipalities, b) the Environmental Protection Act, c) the Waste Act, d) the Act on used electrical and electronic equipment, e) the Act on batteries and accumulators, f) the Water Law, g) the Ordinance of the Minister of the Environment on safety and hygiene at work in municipal waste management, h) the Ordinance of the Minister of the Environment on detailed requirements for the collection of municipal waste from property owners, i) the Ordinance of the Minister of Climate and Environment of 10 May 2021 on the method of selective collection of selected waste fractions, j) the Ordinance of the Minister of Climate on the waste catalogue, k) the Resolution on the establishment of the Regulations for maintaining cleanliness and order in the Municipality of Legnica, l) the Resolution on the detailed manner and scope of providing services in the field of collecting municipal waste from property owners and managing these wastes, in exchange for the fee for municipal waste management paid by the property owner, m) Directive 2008/98/EC of the European Parliament and of the Council of 19 November 2008 on waste and repealing certain Directives, n) the Personal Data Protection Act, o) the Road Traffic Act, p) the Act on electromobility and alternative fuels, q) other normative acts in force in the area of the Municipality of Legnica containing generally applicable legal provisions. *In the event of a change in legal regulations affecting the performance of the service, the Contractor is obliged to continuously monitor legal acts and adapt the manner of providing the service to the introduced changes. *The detailed conditions for the implementation of the subject of the contract have been specified in the OPZ-annex to the SWZ and in the Project of the agreement with annexes, constituting an element of the SWZ.
