France – Sports facilities operation services – Concession de service public pour l'exploitation, l'entretien et la maintenance du Centre aquatique l'Odyssée'O et de la Piscine d'été de la Ville de Saint-Paul-Trois-Châteaux

The present consultation aims to award the service concession contract for the operation of the aquatic centre and summer swimming pool of the city of Saint-Paul-Trois-Châteaux, launched in accordance with the provisions of Articles L.1411-1 and R. 1411-1 of the General Code of Local Authorities (CGCT) and the Public Procurement Code. It has been decided to use an open procedure, in accordance with the Council of State ruling of 15 December 2006, Société Corsica ferries (case no. 298618), the terms of which are confirmed - implicitly but necessarily - by the Public Procurement Code. Under the future contract, the concessionaire will be entrusted with the management and operation of the aquatic centre and summer swimming pool and all related public service missions, thereby transferring a risk related to the operation of the delegated service. The concessionaire's remuneration will come, for a substantial part, from the operating revenues of the activities for which it will be responsible, but also from a fixed public contribution which will be paid to it by the Granting Authority and which will be defined within the contract project.
