The subject of the contract is forestry services in accordance with the definition in Article 6, paragraph 1, point 1 of the Act of 28 September 1991 on Forests, including works in the field of forest cultivation and protection, fire protection, timber harvesting and extraction, as well as nursery, seed production and soil preparation, to be carried out in the Turek Forest District in 2027. The scope of the contract subject includes the summary quantities of works in the Packages resulting from Appendix No. 2 to the SWZ. The material scopes listed in the appendices constituting Appendix No. 2 are of an estimated nature. The quality standards relating to all essential features of the subject of the contract are specified in Appendix No. 3 to the SWZ. The standards specified in Appendix No. 3 to the SWZ: description of the standard of technology for performing individual forestry works (activities), description of the standard of technology for performing works in the field of nursery management (activities), description of the standard of technology for performing fire protection works constitute the basis for determining the quality requirements relating to the elements constituting the subject of the contract. The subject of the contract has been divided into 8 parts ("Packages") Package No. 1 - forest districts: Brudzew, Krwony, Uniejów; Package No. 2 - forest districts: Czarny Las, Linne; Package No. 3 - forest districts: Cisew, Kotwasice; Package No. 4 - forest districts: Grzymiszew, Imiełków, Wyszyna; Package No. 5 - forest districts: Wrząca, Zdrojki; Package No. 6 - specialist (mechanical timber harvesting and extraction - Linne district); Package No. 7 - specialist (mechanical timber harvesting and extraction - Turek district); Package No. 8 - specialist (seed production, nursery, soil preparation). The Contractor may submit an offer for one or more Packages. The works will be carried out in the areas of the forest districts - appropriate for a given Package ("Package Implementation Area"). The location (forest address) of individual forestry works included in the scope of the Contract Subject, as indicated in the appendices to the SWZ, is preliminary. The location (forest address) of individual works will be specified in the Order, with the reservation that it will always be the Package Implementation Area. The Contracting Authority reserves the right, in justified cases, to make corrections reducing, increasing, setting new locations, as well as suspending the performance of activities indicated in individual rows of the tables describing the subject of the contract. During the implementation of the subject of the contract, in addition to the provisions of the law in force on the territory of the Republic of Poland, the Contractor will be obliged to apply and comply with the obligations and rules resulting from the documents, instructions and rules indicated in the SWZ. The Contractor will be obliged to comply with the technical conditions for timber raw material described in the SWZ. The Contracting Authority, in accordance with Article 95 of the PZP, requires the Contractor or subcontractor to employ, on the basis of an employment relationship, persons performing activities in the field of contract implementation, involving the harvesting and extraction of timber raw material, if the performance of these activities involves performing work in the manner specified in Article 22, paragraph 1 of the Act of 26 June 1974 - Labour Code. With regard to each Package, the Contracting Authority is entitled to commission the Contractor with an additional material scope in relation to each of the positions of the Offer Cost Estimate constituting part of the Offer ("Option"). The subject of the Option will be the same (analogous) works as described in the SWZ and priced by the Contractor in any of the positions of the Offer Cost Estimate constituting part of the Offer. Within the Option, at the choice of the Contracting Authority, all, some or only one of the works indicated in the SWZ and priced by the Contractor in the Offer Cost Estimate constituting part of the Offer may be commissioned. Works that are the subject of the Option may be commissioned in a quantity, the total value of which will not exceed 30% of the Remuneration from the date of conclusion of the Contract. The Contracting Authority envisages the possibility of awarding contracts, as referred to in Article 214, paragraph 1, point 7) of the PZP, within a period of 3 years from the date of awarding the main contract - the contracts will involve the repetition of services consistent with the services constituting the subject of this contract and services similar to them in terms of the technological nature of their implementation, which result from the forest management plans valid in the administrative area of the forest district, or which, in connection with ensuring proper forest management, have become necessary to carry out as a result of or in connection with natural, climatic or atmospheric events (the material scope of the services constituting the subject of the contracts referred to in Article 214, paragraph 1, point 7) of the PZP, will not exceed the value of 50% of the value of this contract). On the basis of Article 121, point 1 of the PZP Act, the Contracting Authority reserves the obligation of personal performance by the Contractor of key tasks constituting the subject of the contract. The Contracting Authority considers the following to be key tasks: a) in territorial packages (1-5): harvesting of timber raw material (including felling, felling, processing) and extraction of timber raw material - within the scope of felling II and felling III. b) in harvester packages (6-7): harvesting of timber raw material (including felling, felling, processing) and extraction of timber raw material - within the scope of TWP and felling III. The Contractor may entrust the implementation of the remaining elements (parts) of the subject of the contract to subcontractors. The Contracting Authority requires the provision of a guarantee in the amount of (PLN): Package No. 1 - 21,000 PLN, Package No. 2 - 23,000 PLN, Package No. 3 - 18,000 PLN, Package No. 4 - 19,000 PLN, Package No. 5 - 23,000 PLN, Package No. 6 (H) - 11,000 PLN, Package No. 7 (H) - 9,000 PLN, Package No. 8 - 10,000 PLN. Estimated implementation period: 02.01. - 31.12.2027. Estimated maximum contract value excluding VAT: 12,757,081.82 PLN.
