1. The procedure is conducted to conclude a framework agreement for the supply of data carriers. 2. Partial offers are accepted, divided into 2 tasks: 1) Task 1 – Supply of data carriers: disks; 2) Task 2 – Supply of data carriers: tapes. 3. The detailed description of the subject of the order is Annex No. 5A-5B and Section XIX SWZ and Section XIX/XIXa SWZ (according to the task). 4. The Purchaser requires the indication in the Price Form of the Manufacturer, type/model/version or other data unequivocally identifying the offered assortment. In the event of not indicating in the offer data unequivocally identifying the offered assortment, the Purchaser will reject the offer on the basis of art. 226 para. 1 point 5 of the Act. The term "Manufacturer" shall be understood as the name of the company under which the offered assortment is sold, or the entrepreneur introducing the goods into circulation in the territory of the Republic of Poland. 5. The Contractor will be obliged to provide a minimum of 24 months warranty and guarantee for the supplied assortment, counted from the date of signing by the Parties without comments of the protocol of quantitative acceptance of the delivery. 6. The Purchaser does not require the submission of subject evidence with the offer. 7. The Purchaser allows the assignment of part of the order to a Subcontractor. 8. The Purchaser requires the Contractor to indicate in the offer the parts of the order, the execution of which will be entrusted to Subcontractors, and to provide the names of the potential Subcontractors, if they are already known. 9. Delivery deadline for the assortment in each task: up to 30 working days, counted from the date of concluding the contract or accepting the request. 10. The deadline for binding the offer in each task is 21.11.2026. 11. The Purchaser will make changes to the contract in accordance with Section XIX SWZ. 12. In accordance with art. 13 para. 1 and 2 of the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27.04.2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (i.e. OJ EU L 119 of 04.05.2016, p. 1), hereinafter referred to as the "RODO", the Purchaser informs that: 1) the administrator of your personal data is the Commander of the Capital Police; 2) the supervision over the proper processing of personal data is exercised by the data protection inspector: address: ul. Nowolipie 2, 00-150 Warsaw; e-mail address: [email protected] 3) your personal data will be processed on the basis of art. 6 para. 1 lit. c RODO for the purpose related to the procedure conducted in the open tender procedure for the conclusion of a framework agreement for the supply of data carriers (Procedure No.: WZP-2206/26/118/Ł). 4) the recipients of your personal data will be persons or entities to whom the documentation of the procedure will be made available on the basis of art. 18 and art. 74 para. 1 of the Act; 5) your personal data will be stored in accordance with art. 78 of the Act for a period of 4 years from the date of completion of the procedure for awarding the order, and if the duration of the contract exceeds 4 years, the storage period will cover the entire duration of the contract; 6) the obligation to provide your personal data directly concerning you is a statutory requirement specified in the provisions of the Act, related to participation in the procedure for awarding a public order; the consequences of not providing the specified data result from the Act; 7) with regard to your personal data, decisions will not be made in an automated manner, in accordance with art. 22 RODO; 8) you have: a) the right to access your personal data on the basis of art. 15 RODO; b) the right to rectify your personal data on the basis of art. 16 RODO; c) the right to request the administrator to restrict the processing of personal data on the basis of art. 18 RODO, with the exception of the cases referred to in art. 18 para. 2 RODO; d) the right to lodge a complaint with the President of the Personal Data Protection Office, if you consider that the processing of your personal data violates the provisions of RODO; 9) you do not have: a) the right to erasure of personal data, in connection with art. 17 para. 3 lit. b, d or e RODO; b) the right to data portability, referred to in art. 20 RODO; c) the right to object, in relation to the processing of personal data, as the legal basis for the processing of your personal data is art. 6 para. 1 lit. b, c and f RODO. 13. The Purchaser does not require the Contractor to demonstrate compliance with the conditions specified in art. 112 para. 2 of the Act. 14. The subject order may be applied for by Contractors who are not excluded on the basis of art. 108 para. 1 and 2 of the Act, art. 109 para. 1 point 1, 4, 7, 8 and 10 of the Act, art. 7 para. 1 of the Act of 13.04.2022 on special solutions in the field of counteracting the support for aggression against Ukraine and serving to protect national security (Dz.U. of 2025 item 514) and art. 5k of the Council Regulation (EU) No 833/2014 of 31.07.2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (OJ EU L 229 of 31.7.2014, p. 1), hereinafter: Regulation 833/2014, in the wording given by the Council Regulation (EU) 2022/576 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (OJ EU L 111 of 8.4.2022 p. 1).
