Description

1) The subject of the procurement is the servicing (technical support) of LAN/WAN network devices. 2) The contracting authority's needs and the characteristic features of the subject of the procurement, as well as the minimum requirements regarding the subject of the procurement/implementation of the procurement, which are not subject to negotiation and must be met by all tenders, are specified in Part II of the OPIW, with the proviso that at the stage of publishing the procurement, a shortened description of the needs and requirements of the procurement will be made available – in accordance with the provisions of Article 18 of the Pzp Act. Acting on the basis of Article 381(9) and (133)(3) of the Act, the Contracting Authority establishes requirements regarding the confidentiality of information provided to Contractors during the procedure. The following parts of the OPIW are confidential: - Part II OPIW – Description of the subject of the procurement; - Part IV OPIW Planned provisions of the contract. Contractors invited to participate in the next stage of the procedure, i.e. together with the invitation to negotiate, will receive the documents indicated above. a) Contractors are obliged to submit declarations of confidentiality together with the application for admission to the procedure (Form No. 3 lit. a and lit. b Part III OPIW). b) Declarations must be submitted by persons authorised to represent the Contractor (this authorisation must result from the registry documents or the power of attorney, which the Contracting Authority has in this procedure) and by persons who will participate in the procedure. Declarations must be submitted (included on the e-Procurement Platform together with the application for admission to the procedure) in the form of electronic documents signed with a qualified electronic signature. Note: If the persons who will participate in the procedure do not have qualified electronic signatures, the Contracting Authority allows these declarations to be signed manually by the persons submitting the declarations, scanned, verified for conformity with the original by persons authorised to submit declarations of will and knowledge on behalf of the Contractor and in such form sent to the Contracting Authority via the e-Procurement Platform. c) Information constituting a business secret will be provided to the Contractor in an encrypted form via the e-Procurement Platform. The password to decrypt these documents will be sent to the e-mail address indicated by the Contractor in the application. 3) The Contracting Authority does not allow the submission of partial tenders. 4) The Contracting Authority does not allow the submission of variant tenders. 5) The Contracting Authority does not reserve the right of personal performance by the Contractor of key tasks. 6) The Contracting Authority emphasises that this procedure is conducted in the sectoral negotiation procedure with publication. This means that, after the submission of applications, the conditions for the implementation of the subject of the procurement will be negotiated with the Contractors qualified for the second stage of the procedure. In accordance with the provisions of Article 381(8) of the Act, they may not lead to a change in the minimum requirements and the criteria for the evaluation of tenders and their weights, specified in the notice initiating the procedure and in the description of needs and requirements. 7) Names and codes of the Common Procurement Vocabulary: 72611000-6 - IT equipment servicing. 8) The Contractor is obliged to submit, together with the tender (for the purpose of assessing the conformity of the offered service with the description of the subject of the procurement), in accordance with the provisions of Article 106 and 107 of the Pzp Act, the subject matter evidence which will be the basis for verifying the substantive correctness of the tender: a) a certificate or other equivalent document confirming that the Contractor has the status of an authorised partner of the manufacturer of the Cisco devices owned by PSE, which are the subject of the service (required partnership level: "Preferred Services Partner"). In accordance with the provisions of Article 107(2) of the Pzp Act, the Contracting Authority envisages the possibility of calling on Contractors to supplement the document indicated above - if the Contractor has not submitted the subject matter evidence together with the tender or the submitted subject matter evidence is incomplete. 9) The Contracting Authority requires that the subject of the procurement, including all ICT products, ICT services and ICT processes, in the sense of Article 2, paragraph 11k, 11l and 11m of the Act of 5 July 2018 on the national cybersecurity system, used for the implementation of the procurement – both as main elements and as components, elements of the procurement implementation environment or accompanying solutions – do not include: a) ICT products, ICT services or ICT processes indicated in the recommendation of the Government Plenipotentiary for Cybersecurity, referred to in Article 33(4) and (4a) of the Act of 5 July 2018 on the national cybersecurity system, stating their negative impact on the basic interest of the security of the state; b) ICT products, ICT services or ICT processes, the type of which has been determined in the decision of the minister competent for informatisation in the matter of recognising the supplier as a high-risk supplier, referred to in Article 67b(15) of the Act of 5 July 2018 on the national cybersecurity system. Failure to meet the above requirement will result in the rejection of the tender; in the case of public procurement in accordance with Article 226(1)(17) or (19) of the Pzp Act. The Contracting Authority reserves the right to verify compliance with the above requirement at each stage of the procedure.
