The contractor (AN) commits to providing the managed operation of the casino in the Reichspräsident-Ebert-Kaserne in Hamburg (property), as detailed in the service description in Annex 1 to the service contract, and to ensure this through independent operational planning, including the use of their own goods and personnel. For the provision of the required service, the AN receives a monthly remuneration, the amount and calculation of which must be specified by the AN in their tender. The revenue generated by the AN within the scope of the casino operation also remains with them; only if the turnover achieved by the AN within a calendar year, plus the remuneration paid by the contracting authority (AG), exceeds the costs incurred for the casino operation, the remuneration by the AG is reduced by a portion of the amount exceeding the costs. The contract period is five years (with a possible extension twice by one year each). The current planned start of service is 01.04.2027; this is explicitly not guaranteed and may change during the course of the tendering procedure. The subject of the service is the provision of an attractive gastronomic offer by the AN, which, in addition to meals oriented towards the troops, creates an atmosphere that invites one to linger and enables a convivial togetherness. For the operation of the casino, the AG provides the AN with premises (including outdoor facilities) and property materials located therein. The transfer is free of charge, i.e. no rent is charged. The AG also bears the costs for the property operating services provided by the AG (Facility Management such as media supply (water, electricity, heat), wastewater disposal and waste disposal). Details are regulated in the regulations for the transfer of Bundeswehr properties to third parties as contractors [RÜL] (Annex 3 to the service contract). The equipment of the casino terrace and the design of the ambience in all dining rooms and on the terrace are carried out by the AN at their own expense. The AN is also responsible for the procurement of the cash register system. The AN must offer certain dishes and beverages at contractually fixed prices (see Annex 9 to the service contract, basic range). The prices are adjusted to the price development in February each year. The availability of the basic range must be ensured. For all dishes beyond the dishes of the basic range, the AN is free to set the prices. In addition to the casino operation, the AN also offers catering from other sources, a form of communal catering. A separate remuneration is paid for services of catering from other sources and the provision of services is regulated in a separate contractual annex. Details can be found in the contract documents, in particular the service contract and the service description in Annex 1 to the service contract. In the tendering procedure BV1 26 MoKa RK N/005, the documents "Service Description" and "Service Contract" contain classified components and are therefore not published in the selection competition. These documents are only published or made known in the tendering phase. Participation request: A non-formal participation request in German language on company letterhead must be submitted via the Evergabe platform, which must be provided with an advanced signature, qualified signature or company stamp/signed scan. The participation request must contain a self-presentation of the company, which should be approximately half to one page long. The self-presentation must demonstrate the fulfilment of the eligibility criteria (including insurance coverage); the contracting entity reserves the right to request evidence (analogous to § 22 Abs. 2 VSVgV). The following four forms must be completed and attached to the participation request: (1) Form BAAINBW B-V31 Declaration of Confidential Matters; (2) Form B-V034 Grounds for Exclusion; (3) Form Declaration RUS; (4) Form BAAINBW-B096a Information Sheet on Confidential Matters. The forms must be provided with an advanced signature, qualified signature or company stamp/signed scan. If there is a bidder consortium, the form B-V047 Bidder Consortium must also be attached. After the completion of the selection competition, the admitted companies receive an invitation to tender. The subsequently submitted tender must be binding. The contracting authority reserves the right to award the contract to the first tenders as well as to conduct negotiations.
