Poland – Refuse and waste related services – ODBIERANIE, TRANSPORT I ZAGOSPODAROWANIE ODPADÓW KOMUNALNYCH: - Z TERENU MIASTA PIOTRKOWA TRYBUNALSKIEGO Z NIERUCHOMOŚCI W CAŁOŚCI LUB CZĘŚCIOWO ZAMIESZKANYCH PRZEZ MIESZKAŃCÓW MIASTA, - Z MIEJSKIEGO PUNKTU SELEKTYWNEGO ZBIERANIA ODPADÓW KOMUNALNYCH (PSZOK) ORAZ DZIERŻAWA POJEMNIKÓW.

The subject of the contract is the provision of the service of collection, transport and disposal of the entire mass of municipal waste collected from the owners of properties, where residents live or partially live, in the City of Piotrków Trybunalski, from sectors I, II, III: a) from the area of properties inhabited or partially inhabited: mixed municipal waste; municipal waste collected selectively with a division into: waste from plastics (e.g. packaging polystyrene), metals and multi-material packaging - container (marked) or bag in yellow, paper and cardboard - container (marked) or bag in blue, glass packaging - container (marked) or bag in green, bio-waste – container (marked) or bag in brown, ash – container (marked) or bag in grey, bulky waste (other than hazardous waste not fitting in containers e.g. furniture, trolleys, flooring, carpets, duvets, Christmas trees, windows, sanitary ceramics), used electrical and electronic equipment and textiles. b) expired medicines from pharmacies. The subject of the contract is the collection, transport and disposal of municipal waste from the Municipal Selective Waste Collection Point (PSZOK) located at ul. Orlej 11 and the leasing of containers. The contractor, within the scope of the services covered by this procedure, is obliged to: a) collect, transport and dispose of waste collected in PSZOK b) make available for lease functional containers according to the following data: specialist container 100 l x 4 units, container 240 l x 1 unit, container 1100 l x 6 units, container KP 7 (7 m³) x 2 units, container KM 7 (7 m³) x 2 units, container K 20 (20 m³) x 1 unit, container K 31 (31 m³) x 2 units, container K 34 (34 m³) x 3 units, BIG BAG bags x 5 units with a capacity of 1 m³ c) place containers in the location indicated by the Contracting Authority d) maintain containers in an appropriate sanitary, orderly and technical condition, e) equip containers with protective measures against the action of atmospheric factors (e.g. tarpaulins/covers). The contractor is bound by the offer from the expiry of the offer submission deadline until 17.01.2027. 2) The contractor is obliged to provide vehicles used for the implementation of the contract in accordance with the requirements of the Act of 11 January 2018 on electromobility and alternative fuels, in particular with regard to art. 68a para. 1–5, art. 68b and art. 36a of this Act. The minimum shares of vehicles, as referred to in art. 68a para. 1 of the Act, relate to all contracts covered by art. 68a para. 1, awarded by the Contracting Authority in the period from 1 January 2026 to 31 December 2030. When determining the fulfilment of the minimum shares, vehicles used to provide services covered by each contract are taken into account, in accordance with art. 68a para. 5 of the Act. 5) The Contracting Authority requires the employment by the Contractor or subcontractor of persons on the basis of an employment relationship, as referred to in art. 95 of the Pzp Act. The type of activities necessary for the implementation of the contract, which are subject to the requirements of employment on the basis of an employment contract: Part 1-3: transporting waste/ driving waste collection vehicles/ trucks, loading waste into waste collection vehicles/ trucks, coordinating waste collection and disposal work. Part 4: transporting waste/ driving waste collection vehicles/ trucks. Options: 1) The Contracting Authority envisages the application of the right of option, as referred to in art. 441 of the Pzp Act, on the following principles: Part 1 The Contracting Authority may increase the scope of services for the collection, transport and disposal of municipal waste covered by Part 1, by a maximum of 20% of the basic contract value for this part. Part 2 The Contracting Authority may increase the scope of services for the collection, transport and disposal of municipal waste covered by Part 2, by a maximum of 20% of the basic contract value for this part. Part 3 The Contracting Authority may increase the scope of services for the collection, transport and disposal of municipal waste covered by Part 3, by a maximum of 20% of the basic contract value for this part. Part 4 The Contracting Authority may increase the scope of services for the collection, transport and disposal of municipal waste from PSZOK and the scope of container leasing, by a maximum of 30% of the basic contract value for this part. 2) The right of option may be exercised in whole or in part during the period of validity of the contract, in the event of a need to increase the scope of services covered by the given part of the contract. The Contracting Authority is not obliged to exercise the right of option, and the Contractor is not entitled to claim its exercise. 3) The detailed conditions for the implementation of the right of option are specified in the draft provisions of the contract applicable to the given part of the contract. The draft provisions of the contract regarding the public contract are specified in the Draft Contract constituting Part III. The Contracting Authority envisages the possibility of changing the concluded contract. The type, scope and conditions for changing the contract have been specified in the Draft Contract in §16, taking into account the provisions of the Pzp Act. The contractor is obliged to provide a guarantee in the amount of: Part 1 – 1,000,000.00 PLN, Part 2 – 700,000.00 PLN, Part 3 – 800,000.00 PLN, Part 4 – 200,000.00 PLN. The contractor is obliged to provide security for the proper performance of the contract in the amount constituting 5% of the gross price given in the offer in the forms specified in art. 450 para. 1 of the Pzp Act. 5) The Contracting Authority requires the employment by the Contractor or subcontractor of persons on the basis of an employment relationship, as referred to in art. 95 of the Pzp Act. The type of activities necessary for the implementation of the contract, which are subject to the requirements of employment on the basis of an employment contract: Part 1-3: transporting waste/ driving waste collection vehicles/ trucks, loading waste into waste collection vehicles/ trucks, coordinating waste collection and disposal work; Part 4: transporting waste/ driving waste collection vehicles/ trucks.
