Poland – Road-repair works – Remont infrastruktury drogowej na terenie Miasta Łodzi z podziałem na II części w ramach zadań Budżetu Obywatelskiego

The subject of the contract is the Repair of road infrastructure in the City of Łódź, divided into two parts, as part of the tasks of the Citizens' Budget. The scope of the planned works for both parts includes: Profiling the subbase with a mineral-cement-emulsion mixture using the deep recycling method, demolition and milling of the surface, execution of new structural layers, execution of new bituminous layers, execution of new surface – concrete paving, bituminous surfaces, strengthening of the shoulder, repair of ancillary infrastructure, sidewalks, parking spaces, planting of greenery. Execution of the project and implementation of the Permanent Traffic Organization - with replacement of all elements with new ones. 4.1.1. Part I Implementation of the task from the citizens' budget Task 1. W211DL - modernization of the surface of ul. Okólna on the section: ul. Opolska in the direction of ul. Brylantowa, Task 2. W175ST - modernization of the surface of ul. Jędrowizna on the section: ul. Hyrna in the direction of ul. Juhasowa. 4.1.2. Part II Implementation of the task from the citizens' budget B166TW - modernization of the surface of ul. Wolińska. 4.2. The contract has been divided into parts. The contractor does not allow the Contractor to submit offers for more than one part of the contract. 4.3. A detailed description of the subject of the contract is in Appendix No. 1 to SWZ, Technical Specification for the Execution and Acceptance of Construction Works and in the contract template constituting Appendix No. 7 to SWZ (one template for all parts of the procedure). Ignacego Skorupki 21, 90-532 Łódź tel.: +48 (42) 638-48-88 e-mail: [email protected] 33.1 Based on art. 95 para. 1 of the Pzp, the Contractor requires (for each part separately) the Contractor or Subcontractor, based on an employment contract, to employ persons performing the activities indicated by the Contractor in the scope of the implementation of the contract, if the performance of these activities consists of performing work in the manner specified in art. 22 §1 of the Act of 26 June 1974 – Labour Code (Journal of Laws of 2025, item 277), i.e. persons performing, during the implementation of the contract, work in the scope of: managing or operating road equipment. 33.2 The Contractor has the right to request from the Contractor a photocopy of the current employment contract. The photocopy of the contract should include the first and last name of the employed person, the date of conclusion of the contract, the type of employment contract, the scope of the employee's duties. 33.3 The type of activities related to the implementation of the contract and the method of verifying the employment of these persons and the Contractor's rights in the scope of controlling the Contractor's compliance with the requirements related to the employment of these persons as well as the sanctions for their non-compliance have been specified in the description of the subject of the contract (Appendix No. 1 to SWZ) and in the contract template (Appendix No. 7 to SWZ. 23. The Contractor does not require the submission of objections 24.1. The Contractor, whose offer has been selected, is obliged to provide a guarantee of proper performance of the contract in the amount of 5% of the total gross price given in the offer for the given part of the contract. 16.7. In accordance with art. 257 of the Pzp, the Contractor does not foresee the invalidation of the subject of the procedure, if the public funds, which the Contractor intended to allocate for the financing of the whole or part of the contract, have not been granted to it. 9.7. Information on certification: 9.7.1. Obtaining certification of public procurement contractors and using the certificate is voluntary. The Contractor does not require the possession of a certificate as a condition for applying for a contract. 9.7.2. The Contractor may, pursuant to art. 124 para. 2 of the Public Procurement Law, instead of the appropriate personal evidentiary means, submit a certificate confirming the granting of certification of public procurement contractors in the scope of non-exclusion or the contractor's ability to properly perform the contract. 9.7.3. The certificate replaces personal evidentiary means only to the extent that its content confirms the grounds for exclusion or the conditions for participation in the procedure required by the Contractor. 9.7.4. If the certificate does not cover all the grounds for exclusion or the conditions for participation required in this procedure, the Contractor proves the remaining circumstances by means of personal evidentiary means indicated in the SWZ. 9.7.5. The Contractor does not require personal evidentiary means in the scope covered by a valid certificate, with the reservation of art. 124 para. 4 of the Pzp, art. 31 para. 6 of the Act on the certification of public procurement contractors and circumstances not covered by the statutory scope of certification. 9.7.6. The certificate does not replace the declaration, referred to in art. 125 para. 1 of the Pzp, including the European Single Procurement Document, or declarations and documents required in the scope of the sanctioning grounds resulting from art. 7 of the Act on counteracting the support of aggression on Ukraine and Council Regulation (EU) No. 833/2014. 9.7.7. The certificate does not confirm the events, referred to in art. 4 para. 3 of the Act on certification, that have occurred in this procedure. These circumstances are subject to separate examination by the Contractor. 9.7.8. The Contractor submits the certificate at the stage at which, in accordance with the Pzp and SWZ, it is obliged to submit personal evidentiary means replaced by the certificate. 9.7.9. The Contractor verifies in the Database of Certification of Public Procurement Contractors the authenticity, validity period, status and scope of certification and the authorization of the certifying entity.
