Poland – Construction work for water and sewage pipelines – Zadanie nr 7 - Budowa systemu kanalizacji sanitarnej w ul. Browarnej, Za Walcownią i Zalesie w Kielcach w ramach Projektu „Poprawa gospodarki ściekowej na terenie kieleckiego obszaru metropolitalnego – etap II" dofinansowanego z Funduszu Spójności w ramach Programu Fundusze Europejskie na Infrastrukturę, Klimat, Środowisko 2021-2027

The subject of the contract includes the execution of Construction Works involving the construction of a sanitary sewerage system in the city of Kielce as part of Task No. 7 - Construction of a sanitary sewerage system in ul. Browarnej, Za Walcownią and Zalesie in Kielce, to be carried out in accordance with the CONTRACTUAL CONDITIONS FOR ENGINEERING AND BUILDING WORKS DESIGNED BY THE EMPLOYER, first edition in English 1999, published by the International Federation of Consulting Engineers (Federation Internationale des Ingenieurs-Conseils - FIDIC) PO Box 311, CH-1215 Geneva 15, Switzerland, and the fourth edition in English-Polish 2008, (red FIDIC). 2. The execution of the subject of the contract includes: - the construction of gravity sanitary sewers with a total length of approx. 1214.0 m with PVC pipes and fittings, bell-shaped, class SN12, solid, with a diameter of Ø200x6.5mm, - the construction of network connection sections (ONS): length approx. 103.40 m with PVC pipes and bell-shaped fittings, class SN12, solid, with a diameter of Ø160x5.2mm, - the reconstruction of a water supply section Ø110mm PVC to a water supply PE 100 SDR 11 Ø125 mm with a length of approx. L=100.00 m, including: the reconstruction of existing connections with PE 100 SDR 11 pipes with diameters: Ø63, Ø50, Ø40 mm in the road corridor with a total length of L=11.45m, - tree felling and compensatory planting – in accordance with the annex to the OPZ No. III.5 (inventory of greenery) and III.6 (decision allowing felling). The rules for tree felling and protection are described in the Technical Specification ST-01.00 General Requirements, point 1.6.12 and ST-04.00 Earthworks, point 5.5. 3. The Employer requires that, when determining the amounts, the Contractor familiarises himself with all the elements of the SWZ and analyses the conditions of the Contract, OPZ, information, instructions or descriptions of works and the materials used. 4. The Employer informs that the item attached to the SWZ serves only as an auxiliary material and does not constitute the basis for the preparation of the offer by the Contractor. The basis for calculating the estimated price of the offer is the description of the subject of the contract (OPZ). 5. The subject of the contract also includes remedial works related to restoring the site to a condition in accordance with the surface restoration conditions issued by the road managers, the execution, agreement and approval of traffic organisation projects and the payment of a fee for occupying the road corridor in accordance with administrative decisions, the payment of a fee for the possible occupation of real estate for the needs of the construction site or for other purposes of the task implementation during the work execution, the carrying out of final tests, the costs of eliminating all defects in the works. The Contractor will also carry out the necessary actions to hand over the works for operation. The Contractor will bear the costs of permanently placing foreign devices in the road corridor until the end of the calendar year in which the Acceptance Certificate was issued. The Employer will bear the costs in the following years covered by the Decision allowing the placement of devices in the road corridor. The exception are devices necessary for the proper execution of the Works, in which case the Contractor will bear the full cost. 6. The Contractor is also obliged to take over the construction site, to tidy up the work area after its completion (restore to the original state) within a deadline not later than the technical acceptance deadline for the works (date of issuing the Acceptance Certificate) and to leave the entire work area tidy, clean and fit for use after the completion of the works. 7. When implementing the contract, the Contractor should take into account the method of operating the sanitary sewerage system and the need to successively connect the sections under construction to the operating sanitary sewerage system and to discharge sewage to the city of Kielce's sewerage system. The Employer informs that the Contractor should take into account the successive connection of the following residents to the newly built network, including residents not included in the project, without the Contractor making claims and without the loss of the warranty for defects for the Employer, to which the Contractor expresses agreement. 8. Before starting the works, the Contractor is obliged to submit a "notification of commencement of works" to the Customer Service Office of Kieleckie Wodociągi Sp. z o.o. 9.
