The subject of the contract is the conclusion of a framework agreement for the supply of basic laptop computers in a maximum quantity of 2000 units within the 24-month validity period of the framework agreement. 2. The delivery includes new basic laptop computers meeting all the minimum requirements specified in Annex No. 1.1. to SWZ (technical description of the offered equipment) and in Annex No. A to the Subject of the Contract Description (concerns network management software for computers and printing devices) and in Annex No. B to the Subject of the Contract Description (concerns contract conditions), which are annexes to the contract (PPU). 2.1. All the requirements specified in the above-mentioned documents are minimum requirements, and their fulfillment is obligatory. Failure to meet the above minimum requirements will result in the rejection of the offer as non-compliant with the contract conditions based on Article 226(1)(5) of the Pzp Act. 3. The contracting authority requires that the offered service (equipment), including all ICT products, ICT services and ICT processes used to implement the contract, both as main elements and components, service environment elements or accompanying solutions, does not include on the date of submission of the offer: 3.1. ICT products, ICT services or ICT processes indicated in the recommendation referred to in Article 33(4) of the Act of 5 July 2018 on the national cybersecurity system, stating their negative impact on the basic interest of the state's security; 3.2. An ICT product whose type has been specified in a decision on recognising a supplier as a high-risk supplier, referred to in Article 67b(15) of the Act of 5 July 2018 on the national cybersecurity system, or ICT services or ICT processes specified in that decision. 4. If it follows from the content of the offer, declaration or documents submitted with the offer or from the explanations of the Contractor that the offer includes solutions referred to above in points 3.1 - 3.2, then this offer is subject to rejection on the basis of Article 226(1)(17) or (19) of the Pzp Act. 5. In order to confirm the compliance of the offered subject of the contract with the requirements specified above in points 3.1 – 3.2, the Contractor submits with the offer a relevant evidential means, i.e. a declaration, the template of which is Annex No. 1.2 to SWZ - List of ICT elements used during the implementation of the contract. The Contractor is obliged to unambiguously identify each offered ICT solution in the above list by indicating the information required in the table. 6. The contracting authority does not divide the contract into parts. Therefore, the contracting authority does not allow the submission of partial offers, as referred to in Article 7(15) of the PZP Act. The Contractor must submit an offer covering the entire range of products constituting the subject of the contract. 6.1. The contract has been covered by one part, in terms of purchasing laptops of one type, because the subject of the contract is homogeneous in terms of functional, technical and intended use. All ordered devices have identical technical requirements and will be used for similar daily official tasks. The framework agreement for one basic laptop type brings both economic and organisational benefits. It helps to eliminate the increase in contract implementation costs, complications related to managing supplies, service and warranty, ensuring a uniform hardware and IT environment. 7. The contracting authority plans to conclude a framework agreement with 5 (five) Contractors, whose offers will be the most advantageous of all submitted offers, after awarding points according to the offer evaluation criteria specified in Chapter XIX of the SWZ. The rules for awarding contracts are indicated in Chapter VI, point 13 of the SWZ and in § 2 of the Draft Framework Agreement Clauses (Annex No. 2.1 to the SWZ). The offer binding period expires on 28.12.2026. The RODO information clause has been included in Chapter II of the SWZ. The contracting authority does not envisage the application of the procedure referred to in Article 139 of the Pzp Act, known as the "reverse procedure". The contracting authority requires the submission of the JEDZ together with the offer by all contractors. The contracting authority plans to grant advances for the implementation of the contract according to the rules specified in § 2(13) of the framework agreement and § 2(16) of the draft contract. The contracting authority does not require the provision of security for the proper performance of the contract. The delivery locations will be the contracting authority's warehouses located in Wrocław: the KWP warehouse in Wrocław at ul. Podwale 31-33, ul. Poznańska 48-80 or another warehouse indicated by the contracting authority. The exact delivery address will be indicated to the Contractor in the invitation to tender. The implementation deadlines for the contracts in the framework of individual invitations will be specified in the contract and determined depending on the type and quantity of equipment. The contracting authority envisages the possibility of changing the concluded agreement in relation to the content of the selected offer within the scope indicated in § 4 of the FRAMEWORK AGREEMENT, constituting Annex No. 2 to the SWZ. 1.
