Poland – Cereals, potatoes, vegetables, fruits and nuts – Dostawy warzyw i owoców świeżych

1. The subject of the contract is the successive delivery of fresh vegetables and fruits to the Police School in Piła in an estimated quantity of 97 725 kg. 2. The detailed description of the subject of the contract and the full list of the assortment that is the subject of the deliveries, as well as the estimated quantity of the ordered products, have been provided in the Quantity-Specific Specification, which is Annex 2 to the SWZ. This annex is part of the offer and must therefore be submitted in the form provided for the offer. The quantities given are estimated and do not oblige the Contracting Authority to purchase the products in these quantities. 3. The Contracting Authority reserves the right not to implement the subject of the contract up to 50% of the total gross remuneration. The Contractor has no financial or legal claims for the non-implementation of part of the contract. 4. Delivery, unloading and bringing the subject of the contract will be carried out at the Contractor's expense, included in the price of the products covered by the public procurement contract. 5. The delivery of the subject of the contract will be carried out by the Contractor's transport means authorised to transport food. 6. The Contractor is obliged to have an up-to-date certificate of entry in the register of establishments subject to official control by the competent authorities - in accordance with the Act of 25 August 2006 on food and feed safety (i.e. Journal of Laws of 2023, item 1448) or an up-to-date administrative decision on entry in the register of establishments or on the approval of the establishment issued by the district veterinary doctor together with the assigned identification number in accordance with Article 21(4) of the Act of 16 December 2005 on animal-origin products (i.e. Journal of Laws of 2023, item 872 with later amendments). The Contractor must be under the constant supervision of the competent authorities. 7. The offered products must meet the requirements listed in the applicable laws governing the production and trade of food. Each product must be produced and introduced into circulation in accordance with the requirements of the HACCP system. 8. The contract will be implemented successively: from the date of signing the contract, no earlier than 1 MARCH 2027 to 31 DECEMBER 2027 or until the total gross remuneration resulting from the contract is exhausted earlier. The planned start date for the implementation of the contract is 1 MARCH 2027. 9. The Contracting Authority specifies the date of completion of the contract, as these are periodic deliveries. Indicating a specific date of completion of the contract will ensure the continuity of deliveries. 10. In accordance with Article 455(1)(1) of the Pzp Act, the Contracting Authority envisages the possibility of extending the contract implementation period by up to 2 months after the date specified in the contract, if the funds resulting from the concluded contract are not exhausted within the period specified in paragraph 1 and a contract resulting from the next procedure is not signed. In order to introduce the above change, an annex to the contract will be concluded. 11. Deliveries of goods will take place 5 times a week from Monday to Friday from 06:00 to 08:00 at the Contractor's expense and risk. In justified cases, the Contracting Authority may require the Contractor to carry out deliveries also on Saturdays from 06:00 to 08:00. 12. Place of contract performance: the food warehouse of the Food Section of the Police School in Piła, Plac Staszica 3, 64-920 Piła.
