1. The subject of the procurement is the successive delivery of notebooks, docking stations, desktop computers, and monitors in 2 packages for the needs of the Medical University of Gdańsk (for a period of 6 months or until the contract amount is exhausted).

2. The subject of the procurement consists of the following packages, described in detail in Annex 3 to this SWZ: Package 1 – computer equipment and monitors, Package 2 – notebooks and docking stations.

3. Detailed descriptions of the minimum required technical parameters of the equipment that is the subject of the procurement are specified in Annex 3 to the SWZ. The quantities of equipment are specified in Annex 4 to the SWZ.

4. The contracting authority requires that:

a) the offered equipment is factory new, free of any defects and damage, and has not been previously used;

b) the offered equipment is produced after 1 January 2026;

c) the offered equipment meets all the standards set for such goods by Polish law;

d) all computers and notebooks are equipped with a 4-pair UTP patchcord cable, category 5e, minimum length 5m;

e) computers and monitors are delivered with necessary connection cables;

f) computers and notebooks are delivered with an installed operating system (a partition with system recovery tool is present on the disk);

g) The Contractor is obliged to provide a minimum 36-month warranty for all equipment listed in Packages 1 and 2 and all batteries. The Contractor cannot offer a warranty period shorter than 36 months. In the event of an offer with a warranty period shorter than 36 months, the offer will be rejected. In the event of no warranty period being stated (in the offer form), the contracting authority will assume that the Contractor declares that the warranty period is 36 months.

5. The Contractor is obliged to submit, together with the offer, completed forms according to Annex 3 and Annex 4 to the SWZ. The forms must be completed in a clear, precise, complete, and unambiguous manner. Failure to attach the aforementioned forms (Annex 3, 4) will result in the rejection of the Contractor's offer.

6. The contracting authority requires the completion of all positions in the table (Annex 3 and 4 to the SWZ) in order to uniquely identify the product, thus not allowing the assignment of the same identification mark to different products. Each product must have its own individual code. Marking by assigning codes to any group or series of products is not permitted.

7. When completing Annex 3 to the SWZ, the Contractor is obliged to provide the name of the company, the manufacturer of the offered equipment or software, and the identification marks uniquely identifying the offered product without any doubt (component symbols, model, device type, software name and version). For each parameter listed in the table, the specific offered value must be provided. The contracting authority does not allow copying the required parameters, using phrases such as "as required", "in accordance with the requirements of the contracting authority", or similar.

8. In the event of any doubts, in order to verify the full compliance of the parameters of the offered equipment and software with the requirements of the contracting authority, the contracting authority will request the Contractors to present additional documents, information about the given product in order to uniquely determine and confirm whether the offered product meets the requirements set by the contracting authority in Annex 3 to the SWZ.

9. The offered subject of the procurement must be factory new and must meet the minimum technical requirements specified in the description of the subject of the procurement. NOTICE! In the case of: desktop computers (K1 – K3), monitors (M1 – M3), the contracting authority reserves the right to apply a VAT rate of 0% in accordance with art. 83 para. 1 item 26 lit. a) of the Act on Goods and Services Tax of 11 March 2004 (Journal of Laws of 2011 No. 177, item 1054, as amended), provided that the consent issued by the Ministry of Science and Higher Education is obtained. The contracting authority will provide the selected Contractor with written information about obtaining the consent issued by the Ministry of Science and Higher Education, on the basis of which the Contractor will be obliged to issue a correcting invoice.

10. In cases where the documentation or the SWZ contains indications of trademarks, patents, or origin, or references to standards, approvals, technical specifications, it should be understood, in accordance with art. 99 para. 5 and art. 101 of the Public Procurement Law, that this is justified by the specification of the subject of the procurement and the contracting authority cannot describe the subject of the procurement using sufficiently precise terms. In such circumstances, the contracting authority allows for the submission of equivalent solutions in the offer, where the minimum requirements that equivalent solutions must meet are requirements no worse than the parameters indicated in the documentation.

11. The term "successive delivery" should be understood as the successive (partial) delivery of the subject of the contract to the organisational units of the Medical University of Gdańsk from Monday to Friday between 8:00 and 14:00 at the Contractor's expense, to the places indicated by the contracting authority in the notification sent to the Contractor.

12. When preparing the offer, the Contractor should carefully familiarise themselves with the content of all documents constituting the tender documentation, which should be read along with the modifications and changes made by the contracting authority during the course of the procedure.

13. Detailed provisions regarding the performance of obligations related to this procurement are contained in the draft contract – Annex 5 to the SWZ.
