Description

The subject of the contract is the expansion of the server and matrix infrastructure of the Rzeszow appeal, in the scope and manner specified in the Specification of Contract Terms (SWZ). The set of technical and functional parameters, along with a detailed description of the subject of the contract and a product-quantity list, is presented in Annex No. 1 to the SWZ, which is also the Product-Cost Form. The contracting authority does not allow the submission of partial offers. The contractor must submit an offer for the entire subject of the contract. The contracting authority requires that the offered service, including all ICT products, ICT services, and ICT processes used to implement the contract, both as main elements and as components, service environment elements, or accompanying solutions, does not include: 1) ICT products, ICT services, or ICT processes indicated in the recommendation referred to in Article 33(4) of the Act of 5 July 2018 on the national cybersecurity system, stating their negative impact on the fundamental interest of the state's security; 2) An ICT product, the type of which has been determined in a decision on the recognition of a supplier as a high-risk supplier, referred to in Article 67b(15) of the Act of 5 July 2018 on the national cybersecurity system, or ICT services or ICT processes specified in that decision. Failure to meet the above requirement results in the rejection of the offer on the basis of Article 226(1)(17) or (19) of the Pzp Act. The contractor and their subcontractors are obliged to implement the contract using ICT products, ICT services, and ICT processes in accordance with the content of the offer, contract documents, and contract provisions. Replacement of a manufacturer, technology supplier, model, version, service environment, or ICT process during the implementation of the contract may only occur in legally permissible cases and with the requirements arising from Article 454 and Article 455 of the Pzp Act, as well as in accordance with the contract provisions specifying the permissible bases and conditions for change. Such a change must not be in conflict with the contract documents or lead to the implementation of the contract with an ICT product, ICT service, or ICT process, in respect of which there would be circumstances corresponding to the conditions specified in Article 226(1)(17) or (19) of the Pzp Act. The contracting authority will always verify, before selecting an offer, whether a decision has been published covering the product, service, or ICT process that is the subject of the contractor's offer. The examination of offers in the scope of the conditions specified in Article 226(1)(19) of the Pzp Act will also be subject to verification of the list of entities to which a decision of the minister responsible for informatization was issued on the basis of Article 67b(15) of the Act of 5 July 2018 on the national cybersecurity system. This means that, in accordance with the indicated provisions, the minister responsible for informatization, by way of a decision, will recognize a supplier of equipment or software and entities forming part of a capital group, within the meaning of Article 3(1)(44) of the Act of 29 September 1994 on accounting, within which the supplier functions, as a high-risk supplier, if such a supplier poses a threat to the fundamental interest of the state's security. The contracting authority is obliged to verify whether a decision has been issued in respect of the contractor in the form of an announcement in the Official Journal of the Republic of Poland "Monitor Polski" and published on the entity's website of the Bulletin of Public Information of the Ministry of Digitization.
