Description
This framework agreement aims to define the general contractual terms between the contracting authority and the economic operator [framework agreement holder] for the award of future Subsequent Contracts (SC) relating to the supply, with or without installation, of audiovisual broadcasting equipment covered by this framework agreement. The services are generally described in the framework agreement specifications (CCAP, CCTP and annexes) and will be precisely described in the special clauses document acting as a commitment document (CCP acting as AE) and annexes of each future subsequent contract to be contracted with the selected framework agreement holder, following a request from the contracting authority for the latter to complete its offer in accordance with Part II of the CCAP. The consultation was conducted under an open tender procedure in accordance with the provisions mentioned in 1° of Article R. 2124-2 of the Public Procurement Code and Articles R2161-2 to R2161-5 of the Public Procurement Code. NB: The award of subsequent contracts (SC) is carried out under the conditions mentioned in Title II of this document. Form of the framework agreement: This is a single-supplier framework agreement leading to the award of subsequent contracts. This framework agreement aims to define the general contractual terms between the contracting authority and the economic operator (framework agreement holder) for the award of future Subsequent Contracts (SC) relating to the supply, with or without installation, of audiovisual equipment covered by this framework agreement. The services are generally described in the framework agreement specifications (CCAP, CCTP and annexes) and will be precisely described in the special clauses document acting as a commitment document (CCP acting as AE) and annexes of each future subsequent contract to be contracted with the framework agreement holder. Reason for non-allotment: -Allotting in separate lots would restrict competition, as the audiovisual sector is structured around so-called "integrators". Splitting the contract into two lots (supply on the one hand, supply and installation on the other) would be purely artificial. There is a lack of operators specialising in the supply segment alone. Indeed, wholesalers (pure sales) do not or rarely respond to public tenders, whether or not they include services. Furthermore, allotting in separate lots could make it technically difficult or more costly to carry out the services, as separating the services would mechanically increase the cost. This is a real lever for massification, as the equipment represents the predominant part of the budget, the single lot allows for the negotiation of "large account" rates with manufacturers. Allotting would mean dividing the volumes and therefore facing higher unit prices (UP) for identical equipment; Technical description: The services are defined in the Special Technical Clauses Document (CCTP) and its annexes. Single-supplier framework agreement: For the framework agreement, 1 holder will be selected. Offers are valid for 4 months from the deadline set for the receipt of tenders. Aix-Marseille University wishes to use its public procurement as a tool to combat unemployment and socio-professional exclusion. The integration approach constitutes a condition for the execution of the contract in accordance with Article L2112-2 of the Public Procurement Code. Subsequent contracts may include social clauses in their CCP acting as AE to promote the employment of people facing particular difficulties in integration, and to combat unemployment. (the volume of integration hours to be carried out, constituting a mandatory minimum, must be reserved for the employment of one or more people engaged in an integration pathway, this volume of hours will be specified in the subsequent contract) In the event that the contracting authority concerned (AMU) decides to include an integration clause in the subsequent contract, the provisions of the CCP acting as AE and the provisions indicated in Title II - Article 2 will apply.
