A sector dialogue and market survey have revealed that currently, there is no high-performance gigabit infrastructure with an offer of corresponding telecommunications services available throughout the contracting authority in accordance with the goals of the Gigabit Framework Regulation 2.0, and it will not be available in the coming years. Therefore, the contracting authority has applied for funding for a comprehensive gigabit expansion in the viability gap model within the framework of the directive "Promotion to support the gigabit expansion of telecommunications networks in the Federal Republic of Germany - Federal Gigabit Directive 2.0 (Gigabit-RL 2.0)" of 31 March 2023 in the version of the 1st amendment of 30 April 2024 ("Gigabit Directive 2.0") and has received the notice of the final amount of the grant. The funds provided in this funding program in the viability gap model (hereinafter: funds) are to be passed on by the contracting authorities to telecommunications companies in the sense of EU state aid law as investment cost subsidies for the construction and operation of gigabit networks. The same applies to the co-financing by the Free State of Bavaria according to the directive of the State of Bavaria.
