The subject of the contract is the collection and transport of municipal waste from residential and public areas in the municipality of Suwałki. The detailed description of the subject of the contract is specified in Annex No. 2 to the SWZ. The contracting authority does not allow partial offers to be submitted. Division into parts would result in excessive costs of contract execution and serious difficulties in coordinating the actions of different contractors, which would result in improper execution of the contract. The quality requirements referred to in Article 246(2) of the Pzp Act, the contracting authority has described in detail in the description of the subject of the contract and the annexes to the SWZ. In accordance with Article 95(1) of the Pzp Act, the contracting authority requires that the contractor or subcontractor(s) employ, under an employment contract in accordance with Article 22(1) of the Labour Code (i.e. Journal of Laws of 2025, item 277, as amended), all persons who, during the execution of the contract, will perform activities in the scope of the contract execution if the performance of these activities involves performing work in the manner specified in Article 22(1) of the Labour Code under the supervision of another person, in a place and at a time indicated by that contractor or subcontractor - involving: 1) driving specialist vehicles designated for waste collection (drivers); 2) loading waste (loaders); 3) organisation and logistics of municipal waste collection (administrative staff) if not performed by a given person within the scope of the economic activity conducted by that person. The employment referred to above should last for the entire period of contract execution. The requirements regarding the manner of documenting the employment of persons referred to in Article 95(1) of the Pzp Act, the contracting authority's powers in the scope of controlling the contractor's compliance with the requirements referred to in Article 95(1) of the Pzp Act, and the penalties for non-compliance with these requirements, have been specified in detail in the draft contract constituting Annex No. 8 to this SWZ.
