The Contracting Authority, pursuant to Article 38(1) of the Act of 11 September 2019 on Public Procurement (i.e. Journal of Laws of 2026, item 793 as amended), acts as an Agent under the Agreement concluded on 25.11.2024 regarding the implementation of the Project entitled: "Increasing the effectiveness of long-term rescue actions - stage II" and under the mandate to conduct and award a joint contract in its own name and on behalf of and for the benefit of: - the Lublin Voivodeship Commander of the State Fire Service, - the Opole Voivodeship Commander of the State Fire Service, hereinafter referred to as the Beneficiaries. 2. The subject of the procedure is the award of a public contract for the supply of 4 units of light water rescue vehicles for the specialist water diving rescue group, with 4x4 drive, for the organisational units of the State Fire Service from three voivodeships: Warmian-Masurian (2 units), Lublin (1 unit), Opole (1 unit). The subject of the contract has been divided into 2 parts. Part No. 1 - Light water rescue vehicle for the specialist water diving rescue group, with 4x4 drive - 2 units. Part No. 2 - Light water rescue vehicle for the specialist water diving rescue group, with 4x4 drive - 2 units. 3. A detailed description of the subject of the contract is contained in the appendices to the SWZ, i.e. in Appendix No. 1 entitled "Description of the subject of the contract", containing the minimum technical and user requirements for the subject of the contract (the same for each vehicle) and Appendix No. 2 entitled "Contract Draft", specifying the detailed conditions for the implementation of the subject of the contract. 4. The subject of the contract must be factory new, unused, technically sound, safe, compliant with applicable quality standards and norms, complete and ready for use, and must also meet the minimum technical, functional and quality requirements specified in Appendix No. 1 to the SWZ. 5. When calculating the price for the subject of the contract, the Contractor is obliged to include all costs related to the performance of the contract in accordance with the SWZ, including its appendices containing a description of the subject of the contract, up to the moment of acceptance of the subject of the contract by the Contracting Authority without any reservations. 6. Any names (trademarks), standards, assessments and technical specifications indicated by the Contracting Authority in the Description of the subject of the contract are indicative, and their indication is intended to define the expected standard, while the Contracting Authority allows for the submission of equivalent offers pursuant to Article 101(4), (5), (6) of the Pzp Act in connection with Article 99 of the Pzp Act. If the tender documentation specifies specific standards, assessments and technical specifications, the Contracting Authority informs that it allows the use of solutions equivalent to those described by these standards. The Contractor who refers to equivalent solutions described by the Contracting Authority is obliged to prove in the offer - in particular by means of substantive evidence - that the supplies offered by him meet the requirements specified by the Contracting Authority. The trademarks, patents or origin, sources or special processes that characterise the origin of the materials, devices, services indicated in the documentation serve as auxiliary, the use of equivalent materials, devices and other products is allowed provided that the technical parameters are equal to or better than those obtained by implementing the technical documentation instructions and provided that their use does not require the redesign of the solutions contained in the technical documentation. The Contractor who refers to solutions "equivalent" to those described by the Contracting Authority is obliged to prove that the products, devices offered by him meet the requirements specified by the Contracting Authority. In such a case, the offer should include a description of the proposed product, device, containing additionally its technical parameters and the name of the manufacturer. In the event that the Contractor proposes an equivalent product, this information must be included in the offer (then attach the technical specification supplemented by the Contractor with an additional column - Appendix No. 1 to the SWZ).
