Within this procurement procedure, planning services for the project of a new primary school with full-day care in Kolitzheim, district Herlheim, are to be awarded. The subject of the proceedings comprises basic services of building design, performance images of buildings and interior spaces, HOAI performance phases 1 to 9, with a division into contractual performance stages. 1. Regarding the Property The new primary school with full-day care is to be built on the property with the parcel number 1430, district Herlheim. The property is owned by the contracting authority and is currently used for agricultural purposes as arable land based on a lease agreement. The lease ends in October 2026. To the east and west, the property is bounded by two parallel field paths. To the south, the property borders the gardens of the building area "Am Schulweg". There is a land-use plan for the property, but no development plan. The contracting authority decided on 11.11.2025 to draw up a development plan ("Schweickhof Nord Herlheim") for the property. The preparation procedure is expected to be completed in December 2027. The development plan will contain provisions for development. The preliminary draft is expected to be available in October 2026. In parallel with the preparation of a development plan, the land-use plan will be changed. 2. Regarding the Construction Sections The project can be divided into three construction sections. The planning services subject to the proceedings relate exclusively to construction section 1 and construction section 2, which are to be realised in modular construction to reduce construction time, if necessary. In construction section 1, a building part is to be created in which the full-day care, the school administration and a class group will be accommodated. Construction section 1 must be completed and ready for operation by 31.12.2029 at the latest. The four classes of the class group currently housed at the school location in Zeilitzheim are to move into the newly created building part. In construction section 2, a further building part is to be created, structurally connected to construction section 1, in which a second class group will be accommodated. The four classes of the class group currently housed at the school location in Stammheim are to move into this building part. The timing of the construction of construction section 2 cannot currently be determined for economic reasons. Planning services for construction sections 1 and 2 are to commence immediately after the award of the contract. The award of the contract is scheduled for the end of 2026. Whether and when construction section 3, which is to include a further building part, will be realised is currently not foreseeable for the contracting authority. Therefore, no services will be awarded for construction section 3 in this procedure. 3. Costs The contracting authority estimates the costs for construction sections 1 and 2 at a total of approximately 13.3 million euros gross (total costs incl. planning, construction ancillary costs and VAT). Grants from the Free State of Bavaria are to be obtained for the financing of the project. 4. Contract Assumption on the Part of the Contracting Authority The contracting authority intends to commission a suitable company within the framework of a further procurement procedure, which will act as an agent for it and, in this function, will fully assume the function and tasks of the building owner for the project, in particular will ensure the provision of the necessary planning services for the project. In this context, the architect's contract, which underlies this procurement procedure and is part of the procurement documents, provides in § 1.4 that the architect/contractor, upon conclusion of the contract, declares his consent to a contract assumption on the part of the contracting authority in such a way that, after the conclusion of the contract, probably during the execution of the services of the contractual performance stage 1, the company determined in the procurement procedure will enter the contract as the contracting authority in place of the municipality of Kolitzheim and, with its entry, will assume all the rights and obligations of the contracting authority from the contract. The municipality of Kolitzheim will withdraw from the contract with the contract assumption.
