Poland – Public road transport services – Świadczenie usług przewozowych w ramach lokalnego transportu zbiorowego – komunikacji miejskiej, na linii komunikacyjnej nr 0 autobusami elektrycznymi będącymi własnością Zamawiającego.

The subject of the contract is the provision of transport services involving the regular transport of persons by bus as part of the public collective transport organised by the Contracting Authority, within the framework of local public transport – urban transport, on route no. 0, using electric buses owned by the Contracting Authority, according to timetables prepared by the Contracting Authority in 2027 – Part 1. Whenever the term "transport services", "transports", "road transport", "public transport" or "urban transport" is used in the SWZ and in the annexes to the SWZ, including the contract template, it shall be understood as road transport of persons by bus carried out as part of public collective transport – urban transport, as defined in the Act of 16 December 2010 on public collective transport. The subject of the contract does not include the transport of goods. 2) The subject of the contract has been divided into 3 parts: Part 1 - Provision of transport services in the field of public collective transport organised by the Contracting Authority, within the framework of local public transport – urban transport, on route no. 0 by electric buses owned by the Contracting Authority in 2027. Part 2 - Provision of transport services in the field of public collective transport organised by the Contracting Authority, within the framework of local public transport – urban transport, on route no. 0 by electric buses owned by the Contracting Authority in 2028. Part 3 - Provision of transport services in the field of public collective transport organised by the Contracting Authority, within the framework of local public transport – urban transport, on route no. 6 by an electric bus owned by the Contracting Authority in 2029 and the performance of additional services on route 0. Procedures for Part 2 and Part 3 will be conducted as separate procedures. 3) The Contractor is obliged to carry out the subject of the contract in accordance with the applicable legal provisions (laws, regulations, ordinances) applicable to the implementation of this contract. 4) Basic information about the subject of the contract: • The estimated number of bus-kilometres during the contract period is 48,727.50 bus-km. The Contracting Authority reserves the right to reduce the estimated number of bus-kilometres by no more than 10% or to increase it by no more than 5%, according to the rules specified in the contract template. The Contractor is not entitled to any claims against the Contracting Authority for the non-utilisation of the full bus-kilometre pool. • For the provision of services, the Contracting Authority will lend the Contractor, on the basis of a loan agreement constituting Annex No. 1 to the contract template, two electric buses Solaris Urbino 9 electric along with additional and diagnostic equipment and a two-outlet charging station with a power of 90 kW located in Żyrardów at ul. Skrowaczewskiego. The Contracting Authority bears the costs of insuring the buses and the electrical energy consumed by the buses; the Contractor bears the costs of the current operation and maintenance of the buses and the charging station. • The Contractor will provide two reserve buses meeting the technical and operational parameters specified in Annex No. 4 to the contract template, used exclusively in the event of a malfunction or unavailability of the electric buses. • No fares are charged on route no. 0. The preparation of timetables and the introduction of changes to them is the responsibility of the Contracting Authority as the organiser of public collective transport. • The Contractor's remuneration will be determined as the product of the number of bus-kilometres constituting the basis for settlement, i.e. the sum of bus-kilometres performed and 70% of bus-kilometres not performed due to reasons independent of the Contractor (Section 9, Paragraph 3-7 of the contract template), and the offered unit price per 1 bus-kilometre, according to the rules specified in the contract template. 5) A detailed description of the subject of the contract is described in Annex No. 1 to the SWZ – OPZ and in the contract template (Annex No. 3) together with the annexes (Annex No. 1 – bus and charger loan agreement, Annex No. 2 – timetables, Annex No. 3 – rules for the provision of services and quality parameters, Annex No. 4 – technical and operational parameters of vehicles, Annex No. 5 – contractual penalties).
