Poland – Firefighting vehicles – Zakup nowego, średniego samochodu ratowniczo-gaśniczego z układem napędowym 4x4 dla Ochotniczej Straży Pożarnej w Połczynie.

1. The subject of the contract is the "Purchase of a new, medium-sized, 4x4 rescue and fire-fighting vehicle for the Volunteer Fire Brigade in Połczyn". 2. As part of the subject of the contract, the Contractor is obliged to: 1) carry out the basic order, consisting of the delivery of a new, medium-sized, 4x4 rescue and fire-fighting vehicle, hereinafter referred to as the "Basic Order"; 2) in the event that the Buyer exercises the right of option, as referred to in Article 441 of the PZP Act, deliver additional equipment, namely a bull bar for the rescue and fire-fighting vehicle that is the subject of the Basic Order, hereinafter referred to as the "Option". 3. Implementation of the contract subject to the right of Option: 1) The maximum scope of the right of Option includes the delivery of 1 bull bar for the rescue and fire-fighting vehicle that is the subject of the Basic Order. 2) The Buyer is entitled to exercise the right of Option on condition that sufficient financial resources are secured in the Buyer's budget for the implementation of the Option; 3) The right of Option will be exercised by submitting to the Contractor, in electronic form, a declaration of the exercise of the right of Option, no later than by 7 December 2026; 4) In the event of the exercise of the right of Option, the Contractor will be obliged to deliver the bull bar together with the vehicle that is the subject of the Basic Order, by the date specified in Section V, paragraph 2 of the SWZ, i.e. by 11 December 2026; 5) The exercise of the right of Option is the right of the Buyer, not its obligation. In the event that the Buyer does not exercise the right of Option, no claims shall arise for the Contractor against the Buyer on this basis; 6) The remuneration for the implementation of the Option will be in accordance with the price indicated by the Contractor in the Offer Form – Annex 1 to the SWZ. The exercise of the right of Option in accordance with the SWZ and the agreement does not constitute a change to the agreement; 7) The provisions of the draft agreement – Annex 6 to the SWZ – relating to the Basic Order shall apply accordingly to the contract subject to the right of Option, unless the provisions relating to the Option provide otherwise. 4. The subject of the contract is implemented with the involvement of funds from the Main Headquarters of the State Fire Service, the Voivodeship Fund for Environmental Protection and Water Management, funds from the budget of the Municipality of Puck and own funds of the Volunteer Fire Brigade in Połczyn. 5. The minimum technical/quality parameters of the vehicle have been described in Annex 1a to the SWZ "Description of the minimum parameters of the offered vehicle". 6. Each Contractor (in the case of Contractors jointly applying for the award of the contract, the declaration is submitted by each Contractor) must attach to the offer the current, as of the date of submission of the offers: Declaration of non-exclusion and fulfillment of the conditions of participation in the procedure, as referred to in Article 125(1) of the PZP Act, submitted on the form of the European Single Procurement Document (hereinafter: ESPD), constituting Annex 2 to the Commission Implementing Regulation (EU) 2016/7 of 5 January 2016 establishing the standard form of the European Single Procurement Document. The information contained in the ESPD constitutes preliminary evidence confirming the absence of grounds for exclusion and the fulfillment of the conditions of participation in the procedure on the date of submission of the offers, temporarily replacing the documentary evidence required by the Buyer.
